    It's dark, It's the middle of the night. You hear someone trying to kick in your door and you grab your gun. As you go to investigate the door flies open from the last kick. Two BG's have their backs turned to keep from getting broken glass/wood in their faces from the shattered door. Afraid for you and your families life, you let a few fly and hit one of the BG's who are turned. You're scared and shooting in the dark at three figures in your doorway. I'd say that hitting anyone of them on your front porch is a justified shooting. I hope the courts feel the same way. As the old saying goes, I'd rather be judged by 12 then carried by 6.

    if it's three in the morning and you decide to let three criminals into your house before you start shooting you may end up dead yourself, or you may end up shooting one of your own family members.

    I would like to also bring up the fact that the homeowner demonstrated excellent skills in pistol marksmanship, especially for being awoken at 3am. High Five! I am with most of yall, I would have defiantly allowed my Wilson Combat 45 do the talking for me. But very good point have been brought up, you must have a defined reason at the time of pull that trigger, can't be putting your self in a possible position for some hotshot lawyer to put you in jail for something that was questionable. If he's running away, get a good description, and try to help the police in anyway you can. Also another excellent idea is to attend a pistol coarse, shooting on a range and shooting at a criminal in your house at 3am with your family on the otherside of thin walls is a huge difference. That is just one more credential to add to your defense if you ever encounter such incident.

    DENVER - "Go ahead, make my day." With a loaded .44 pointed at a criminal's face, Clint Eastwood couldn't have been more clear when he uttered that famous phrase in 1983's 'Sudden Impact.'

    But Colorado's 'Make My Day Law' is broad and slightly vague when it comes to this week's fatal shooting of a burglary suspect at 3150 N. Gaylord Street in Denver.

    "You don't have to believe (a criminal) is going to kill you or hurt you badly, if they are in your home," said Denver defense attorney Dan Recht. "(If) you think they might hurt you in any way, you can kill them,"

    Police say at least one of the three suspected burglars entered the home on N. Gaylord St. early Monday morning. What is still not clear is whether 17-year-old Marcus Duran, who was shot to death by the homeowner, was actually inside.

    He died from multiple gunshot wounds to the head.

    "We have never seen a case like that where one of the co-conspirators...one of the accomplices...was in the home, but the person who was shot was not in the home," said Recht.

    Colorado law gives homeowners the right to use deadly force, but leaves it up to prosecutors to see if any individual incident falls under the 'Make My Day' statue.

    If the Denver District Attorney decides to charge the homeowner, he could argue at his trial that he was covered by the 'Make My Day Law.'

    At least one of Duran's co-conspirators is charged with burglary. Criminal charges against the homeowner will likely depend on who actually went inside.

    If his co-conspirators had made entry into the house, and this kid was on the porch, then it would make sense that he too was going to enter the house. Or, perhaps the shooter didn't know who or how many or what their intentions were. Please, there were three of them. In my mind, clearly justified.

    They were not there to make a new friend.
