    If the facts as we see them are the case, they DID knowingly and willingly defraud customers by taking money for which they knew there would be no return/goods to the customer. When this is covered by FOIA, it won't make a difference as the bankruptcy will already be finalized, but if anyone were to take evidence to the judge in the case of their filing, they could be denied their motion of a Chapter 7 by the court. The judge would need that information in hand before said hearing, then he/she can force them to paint their timeline of when they received credit counseling, consulted an attorney, etc,. versus when they took money from their so-called "creditors" or customers. I'd find it hard to believe a judge would allow customers in contract to be considered creditors, when in fact every single one opens them to civil penalty and litigation. Honestly, I think what needs to happen is someone in California close to the Pelfrey's home court which they filed with, needs to gather names and amounts ASAP and file a class action lawsuit, because they've already far exceeded the number of people necessary for one, then hand deliver said class action's paperwork to the clerk of the bankruptcy court.

    If anyone wants a real shot at making this right, do what I said, organize the class action, call the California State Attorney General's office, and hand deliver it. After reading the California statutes, this definitely denotes Deceit, potentially Fraud. Honestly, if the case is as mentioned and they took money knowing they were filing, it's definitely fraud as stated in Civ. Code §1572

    These people drove this business face first into the ground. Barring any epic fucking epiphany on their part them running a sucessful business in the future is unlikely.

    That being said, I do wish them the best. I do wish they can recover from this hell hole of an experience. I wish they will keep a tally of the debts they owe everyone and are able to put themselves in a position where they can right this wrong.
    That would be the best case scenario. Even if it is 15 years from now.

    I do think these people are going to lose everything. I think they mortgaged their home to the hilt and borrowed on everything they had to put in their business and will be forced to sell it all. I don’t doubt that. I think thats why they have a nasty attidude. Broke and desprate make great friends with stupid.

    At the end of the day, they have to live with themselves.

    Unfortunately I do think someone could have bought them out if they reached forward early. Instead they burned bridges and refuse to take personal responsibility for their actions.

    I concur, exact reason why I've already reached out to the San Diego FBI Field Office and the Federal Trade Commission. A few of you have already provided me with your contact info that I will pass onto the FBI and FTC for them to reach out to you individually and hopefully bring forth an investigation and or criminal class action case.

    A judge must certify the class, and there is no minimum number to bring a class action, but the more the better. I was involved in a class action on a major corporation with only 9 members in the class. This could see many more than that, I've heard 40 is ideal.

    It's doubtful the FBI will be involved, even though it could be considered fraud over state lines, someone needs to get information to the State Attorney General as well just to see what they have to say on the matter.

    IMO, this is not a clear cut washing their hands and walking away bankruptcy if they were taking money that late in the game. I don't wanna see anyone get into trouble like this, but this just wreaks of BS. IF in fact, people were being allowed to pay and they had no intentions of shipping goods, as they haven't, then I'm sorry but something must be done. Sad.
