    Mn uses probable cause as well. But if you have a conceal n carry you wont neex to worry. They usually look for other stuff n usually triggered by behaviour or smells. Been pulled over alot never searched but always repeat always tell the offucer that i am carrying an ask him what he wants me to do. Usually goes better that way.

    It has really bugged me since I posted earlier. So now that I am done getting the emissions done on my Camry at the dealership and back at the office. I searched up the Supreme Court ruling on warrantless search of a vehicle, so everyone in the Lair can be educated and know their rights as it pertains to search of a vehicle by LEO's.

    In Carroll v. U.S. the Supreme Court found that, due to the mobility of a vehicle, law enforcement officers could not be expected to acquire a search warrant and then find the vehicle waiting for them when they returned. The Supreme Court, in its opinion stated:

    "Police officers who have legitimately stopped an automobile and who have probable cause to believe that contraband is concealed somewhere within it may conduct a warrantless search of the vehicle that is as thorough as a magistrate could authorize by warrant."

    So @Darkgoatracer, the next time an officer tells you they can search your car based on reasonable suspicion because you possess a CCW permit, tell them to shove their Reasonable Suspicion because the Supreme Court required they have probable cause to search your vehicle, especially if they have asked you if you have your weapon with you and you told them no.

    Here is a decent definition of probable cause too.

    "probable cause - n. sufficient reason based upon known facts to believe a crime has been committed or that certain property is connected with a crime. Probable cause must exist for a law enforcement officer to make an arrest without a warrant, search without a warrant, or seize property in the belief the items were evidence of a crime. While some cases are easy (pistols and illicit drugs in plain sight, gunshots, a suspect running from a liquor store with a clerk screaming "help"), actions "typical" of drug dealers, burglars, prostitutes, thieves, or people with guilt "written across their faces," are more difficult to categorize. "Probable cause" is often subjective, but if the police officer's belief or even hunch was correct, finding stolen goods, the hidden weapon or drugs may be claimed as self-fulfilling proof of probable cause. Technically, probable cause has to exist prior to arrest, search or seizure."

    So let me illustrate a situation where he could have searched legally.

    He/she/it stops you for speeding, not signaling, tail light out, etc. He/she/it approaches the car and a conversation ensues. He/she/it sees your CCW permit while you retrieve your license from you wallet. He/she/it then asks you if you have your weapon with you. You reply "no." But while at the window, he/she/it sees a single round of ammo on the passenger floor board, a pistol case or empty magazine in the back seat, or an unusual bulge in your clothing in an area where someone would commonly carry a weapon (we call this the plain sight doctrine). Then the burden of probable cause could be met.

    It is nice because if I get out and want it on my hip, only takes a couple seconds. It also makes it easy to remove it from the vehicle when not in use.

    Daniel, please don't get the wrong impression from any of my responses. I have the great deal of respect for law enforcement and first responders. Our family is entrenched past and present in multiple fields, including the military.

    I am a huge supporter. I'm also a civilian that could be subject to the same injustices as everyone else. I don't take it personal however. If I am doing the crime, I know I might wind up doing the time. Apparently some people in Maryland feel they are having their civil liberties stomped on and want to get away with, literally, murder. That's what makes it hard for the average Joe.

    No worries man! Officers like that are what give the rest of us a bad name. So it really irritates me!

    We have a hard enough time with all the negative publicity that gets circulated by the media these days any time we have to use lethal force. We dont need officers running amuck violating people's 4th amendment rights.

    I carry the Safari land holsters. I don't like the trigger finger actuating the lock plus the lock is visible. Safariland it's actuated with the thumb and very inconspicuous but you can't miss it when you go to grab the pistol.

    Like I led on, and to clarify, when I was younger, I was no stranger to the law. I encountered a couple that were over the top, but were likely reacting to me at the time. For the most though, the rest were professionals. My encounters as of late have only been traffic related but even then I still offer my utmost respect during them. Being nice and not a hazard goes a long way. It's a tough job with little to no reward. I wish that would change.

    I'm sure you get reports about the goings on here in Baltimore. I grew up and use to live here in the city but now we both just work here. I live in Harford County (Town Sheriffs/State Boys). It's night and day obviously. I would not want to be in law enforcement here, especially in Baltimore. I've attended Police Emerald Society events and the bag pipes and dedication ceremonies always bring a tear.

    They can try and use probably cause but there is a very big court case where the Supreme Court ruled also that there has to be reasonable suspicion. It stemmed from a case where cops stopped a couple window shopping and they weren't doing anything wrong. There are other Supreme court rulings on this as well. That is why having a lawyer on call and knowing your rights is key to stop unnecessary/illegal searches without due process.
