I'm in FL and this is exactly why I use State Farm (good insurance). I've been in a few accidents and I always ask for OEM and I've had zero trouble with them. I even had a woman hit me in my old 94 toyota pickup and her insurance refused to use OEM (wanted salvage parts) and I spoke to my agent and State Farm replaced them with OEM and sued her insurance for the repair. I didn't have to do anything. You get what you pay for.

In MN if its only cosmetic its upto the owner. They wanted me to but would only pay 9k. It was appraised at 13.5k by the shop. And 6mt ac 2nd gens are hard to find around here. Plus i just had a new frame installed last year.

Had the whole front end of my truck replaced this spring. I took it to a Toyota collion center my insurance recommended. Insurance said non-OEM, but the shop just price matched the OEM stuff to the allowed cost by insurance. Ended up with all OEM replacements.

I know in TX the insurance company cannot dictate what parts to use. I used to do paint and body years ago and know what they need to do to fix things right. I had a similar situation, drunk lady hit the car behind me at a light. Her insurance gave a quote for around $6K, and it included cutting the bed apart and welding in new panels. I know for a fact that unless you have the correct jig, you can't get it square -- best option is a complete bed assembly if there is that much damage. They also had used exhaust and other parts. I said no freakin' way.

I took it to the shop that does the work for the BMW and Lexus dealers in town, who was a certified shop with my insurance, and filed it under my insurance. I had to pay the deductible, but they fight it out with the other company and refund it, and it doesn't affect your rates. They agreed with my assessment of how to fix it correctly, and the bill was over $13K. Got my $500 back a few months later, but it was worth it.

I've been through this several times. Most insurance companies will quote you aftermarket parts, I've got Geico and they did this to me on my SRT Cherokee when I banged up my wheels. They tried to replace the OEM chrome's with some crap 3rd party non Mopar. They put them on and the color didn't match at all, complained for a few weeks and got OEM's (but only because the color was off!).

If it is not your insurance company, then you never agreed to abide by their 'standard practice' of "non-OEM parts for repairs", so even if that is their 'standard', it is non-binding for you.

You are the innocent party, wronged by their policyholder.

I'd hold fast for OEM parts.

I would definitely fight for OEM. When my 2011 BMW got into a collision last year Progressive tried to use non-OEM parts, they even listed some of the parts wrong, like the wrong style kidney grille and wrong badge for the fender. Hell, they even wanted to use a lower bumper from a different vehicle (totalled) that wasn't damaged. That really shocked me.

So I took the vehicle to an authorised BMW repair shop and had Progressive cover it. They did everything correctly and OEM.

I live in West Palm Beach. Looks like there's a dealership slightly farther north of me that is listed on the Toyota collision center search page and they claim to only use OEM parts. Ill give them a try tomorrow.

I have State Farm as well but the agent I've been talking to told me that the claim is still pending so I would need to pay my deductible and it could take months for me to get it back if the other driver is actually found to be at fault. It's weird because another driver involved has State Farm as well and they were found to be not at fault and their claim was resolved a couple days after the accident occurred. If I keep having issues getting OEM parts from the at fault insurance I'll definitely give state farm another try.

When I had my first gen painted the body shop wouldn't even consider using aftermarket body parts. They told me point blank they rather spend the time trying to fix the minor damage to an OEM fender vs replacing it with some aftermarket recycled Alpo dog food and Starkist tuna cans.
