    Here is a different kind of asshole! Parked over the line because he showed up at work late and drunk. Late but to early to be drunk 9:30am. Not the first time either. Because of laws in this state company can’t fire him. We can only offer him help.

    We didn’t see him drive in but when he came into the room it was obvious. Once we notice it we can’t send him home Incase he hits someone. So we have to call him a cab.

    In my town, a bus driver got arrested for DUI while sitting in the bus at a school. After they were released later that day, they returned to get their car and were arrested again for DUI. Folks in these situations need help, and sometimes that requires hitting rock bottom or at least a push from law enforcement

    We had a contractor get arrested AT HIS DESK because he was drunk at work and had driven here that way. Our armed security walked him to the door, where APD took him and he blew a .14. They figured he was at a .2 when he drove in. We packed all his stuff into a box and he was never seen here again.

    He got the help he needed, but he didn't get it inside this facility.

    If the person is an alcoholic it can be considered a disability... Makes it much harder to fire them. Now, if they were drinking on the job or something, that would be different, but just showing up "suffering from a disability" it has a better chance of being protected.

    That’s exactly what it is here. They can say my work sucks and they don’t need me anymore but he can just say I have a problem and he’s ok.

    The laws in every state allow for employees to be terminated. There comes a point where the employee can't / won't do their job. Once that line is crossed every company in every state can start the process. If it's because of a disability the process is harder, as it should be, but it can be done. There is a lot of work and documentation required of the manager before any termination to keep the company out of law suits. There are probably other reasons why your company doesn't start the process of getting rid of him, but the state laws aren't one of them.
