Truck, Rock and Broken Windshield (Updated)

    UPDATE: I further reviewed the video using some software and was able to trace the rock trajectory even further out of focus. The rock came from a car two car lengths down. The car was in the lane the whole time so no fault to anyone. This time it was just bad luck and now I just have to deal with it. I have already apologized to the truck driver this morning for the misunderstanding. This matter is now closed.




    This is the truck that threw a rock at my windshield. The plate was too blurry but this logo was on the side of the truck.


    Note: This is not a witch hunt, I am certain the driver had no idea.

    Cant read it sorry !!! , but as for windshield damage by rocks from a semi truck good luck getting a trucking company to pay for it . Most Trucking companies have " act of God clauses " and will not cover windshield damage on cars

    I'd search gravel companies in your area (SoCal) and see if you can identify the logo/truck.

    A few years ago near Gardena Ca on the 405fwy at 0500hrs I was behind a Coca Cola semi truck . I heard a loud noise and immediately saw a crack in the windshield

    Knowing this truck did this I got the trailer # , license # then got the tractor # . Later that morning I called the Coca cola distribution center and talked to their dispatch . The dispatcher said that was his truck after I gave him the info but then told me they're not responsible for windshield damage and their insurance has an act of God clause exempting them from windshield damage



    All I can say is good luck in trying to get that gravel truck company to pay for windshield damage !! . As mentioned alot of trucking companies dont pay for windshield damage

    So if you were driving behind another Tacoma and a rock kicked up and hit your windshield, you would track that guy down to get him to pay for it as well? It happens dude, get a windshield deductible on your own insurance and stop trying to blame people for rod debris :notsure:

    Depends, on alot of factors. I'm not one to give up without trying though. We don't have alot of money to spend on a new windshield.

    I've seen a couple of incidents like that where I work at. Good luck. From what the drivers explained to me, you would have to prove you had a good amount of distance between you and the truck. Anything too close, they're not responsible

    As mentioned Trucking companies do not pay out for windshield repairs replacement unless a part or object falls off the truck . A rock being thrown up onto a windshield is out of the drivers control whereas a part or piece of equipment falling off the truck the driver is responsible or control of that action

    Help me understand the legality of an opposing company insurance clause affecting the resulting action placed upon an outside vehicle. I can see an “act of god” clause being placed on the insured vehicle (delivery truck), however how in the hell can it be placed on all other innocent vehicles as legally binding to a non policy holder? And, how is a rock being picked and tossed up by the insured vehicle an “act of god”... if not for the truck, god couldn’t have done it! Such is not anywhere near an “act of god” like sever weather conditions or natural disasters would be... sounds like BS to me.

    Agreed... as long as the delivery truck meets all state safety requirements, such as proper/required mud flaps to assist is reducing such incidents.

    It's a long shot but not impossible. My dad has gotten this covered in the past. This is the same reason why you can get a ticket for not having mud flaps or having tires that stick out past the fenders. If the tires on my lifted truck fire a rock through your windshield because the fenders don't cover them, then I'm liable for that in my state. I'm not saying that's the situation here, but it could have been. A lot of semi trucks don't have fenders over the drive wheels because the trailer theoretically covers them, but it might not on a turn or with a certain trailer.

    And just because their insurance company has a clause stating they won't cover this doesn't remove the trucking company's liability. If I crash into you, but I'm uninsured/underinsured then you can still go after me for damages. They don't just get a pass because their insurance doesn't cover it...
