Your Parking ticket might be unconstitutional if they used chalk!

    According to Article 1 section 7 clause 5 of the U.S. Constitution “No Bill of Attainder or ex post facto Law shall be passed.” Parking tickets...unconstitutional indeed.

    So, the parking enforcement people could just mark the road in front and to the rear of a tire, very close to the tire, and make a note of the veh's registration. Or draw a "U" on the road around the tire. That's what I did after some people complained about receiving a chalk spot on their tire.

    The end of that article says they could take a photo, which is another possibility but IMO unnecessarily complicated.

    It's not our job as citizens to make it easy for the government to search. It seems silly to fight a parking ticket over chalking your tire but it sets a precedent, they have done a warrant-less search of your property and violated the 4th Amendment.

    Make them mark the sidewalk.

    Then sue them for graffiti.

    All these people saying "don't break the law" clearly haven't lived in a place like LA or DC where signs are intentionally bad to bust outsiders and where the parking cops/system are corrupt as hell. I don't know how many tickets I've received in DC over crap they perceived as wrong but aren't worth the $25 ticket to take the day off to contest it.

    Especially now that so many are moving to electronic metering (e.g. single kiosk for the whole street) and apps... there's no physical token when I park now and it's a PITA to remedy when they just give you a ticket without checking their system.

    In the last three years I have gotten two tickets that I (nor my vehicles) wasn't even at the place where the ticket was written! I didn't break any laws, but had to prove I wasn't at fault!

    First was for a parking ticket they wrote against my 2015 Highlander for parking some 75 miles away from my house (where my Highlander was sitting, in the garage) that day! Apparently, whoever wrote the ticket had a couple of the letters/numbers wrong and they came up with my license plate. When I wrote the "City" of question, they said, "Oh, it had been paid so no harm done! HA! I had to waste my time and a stamp to respond, what do you mean no harm done?

    Second was from a "Toll Lane Violation". They said that my motorcycle (again, license plate) was picked up by camera to have been in a toll lane, on such & such a date. That was a pretty good trick since my bike was in storage at the time! So I asked them to send me a picture of the offending motorcycle so I could further prove it wasn't my bike. I never heard back from them!

    These systems of ticketing were you have to prove your innocence, are nothing but a Revenue Enhancement for the cities! And these "Automated Ticketing Systems" on Toll Ways, Red Light cameras or speed cameras should all be banned! If a cop isn't there to write you up, then it should be illegal to ticket you, since too many mistakes are made, accusing innocent people!

    It wont. I'm sure the city will look at the cost of appeal and decide that its cheaper to just adopt a different method of enforcement. They could switch to camera logging, or they could crawl out of their caves and see what the rest of the civilized world is doing, which is having you display your parking receipt on the vehicle.

    1) Only applies in the 6th Circuit; Michigan, Ohio, Kentucky, and Tennessee.

    2) It was a three judge panel. I'd guess that at the least, Saginaw will ask the full panel to revisit the case. Meaning the ruling could change.
