    Not sure how this is legal. You have the right to repair your car. Of course, you also have to obey laws regarding disposal of chemicals, etc.

    I often wonder if these kinds of laws are intended more to eventually force you out of car ownership.

    May not be constitutional but to challenge the law you would need to be affected (i.e. ticketed) and then pay a costly lawyer to challenge the constitutionality of the ordinance. This is one of those laws that will hang out until someone of means takes a hit which is unlikely as they will pay someone to fix it or have a nice enclosed shop.

    Sounds like a "it's good for the community law". That could prevent other crimes from happening. Keeping unsightly project cars off the street, can easily be addressed by enforcing vehicle registration laws. Leaving the property owner the freedom to do what they want on their own property, and unregistered vehicles off the streets.


    Is there a commercial zoning law preventing people from living in automotive shops?

    Could be the easiest work around.

    But changing my shocks in the driveway would be no bueno, that's my own property but seems to be disallowed by the plain English on their website.

    so if anyone says anything, say you need to remove them to change your brakes......Brake jobs are legit and legal by that clause....geeeezuz..I think we can make gooooood excuses for a lot of repairs...but daaaaaaang...Cali,,,,really

    I think HOA's skirt the rules because you agree to abide by the rules when you purchase your property. Many cities have rules about working on vehicles in your yard. Again, to keep neighborhoods from becoming blighted.

    It definitely sucks. Even tho you have the right to repair your vehicle, the Bureau of Automotive Repair has the power to regulate anyone who works on motor vehicles. Usually, that means anyone who charges or operates a business repairing vehicles. Environmental laws apply so venting your Air Conditioning circuit to open air is a no-no. Same with using engine oil to kill weeds.

    I really hope this kind of legislation is challenged-and you don't need to be "of means" to challenge laws. As someone said, you do need to have standing and you do need to demonstrate harm. And the argument can be made this affects the poor disproportionately.

    I believe that some of the concerns stem from pre-1990s when the bay was just a cesspool of oil, antifreeze, and other fluids. I only remember it being a thing because in my old neighborhood, our neighbors were pouring oil and antifreeze down the storm drains. Our next door neighbor was city police and he couldn't give a rats ass about what was going on at the time.

    Things changed in '89 or '90 with Earth Day the South Bay (where I lived).

    • There was a huuge Santa Clara County Earth Day event during one weekend at the San Jose Convention Center.
    • There was also a huge awareness push in public schools and television PSAs about not pouring oil down the storm drains.
    • Around the same time, all the storm drains were spray painted with "no dumping" "this drains to ocean".
    The push didn't fall on deaf ears because today hardly anyone dumps stuff into storm drains in any of the neighborhoods I'm in.

    Another huge benefit to at least making the water clean and clear is that by the late 1990s, no more untreated sewage was being dumped into the bay.

    However, there're still PCB, Dioxin, and other industrial waste buried along the bay. There're also oil spills from poorly maintained vehicles still flowing into the bay after rains. Electric vehicles are going to help in that regard. But for some of the 1960s and 70s industrial waste, it's gonna have to be identified and dredged up.

    All in all I wouldn't be surprised if that piece of legislation was signed into effect somewhere between the mid 1980s to early 90s. Even a few drops of oil here and there, how many people really use sand or litter to exact the oil from their driveways or streets before a rain washes it down the storm drain?

    Not enough to have a build thread.
    To the best of my knowledge, anything but a simple repair, like a brake job, has been technically illegal for a long time. The big concern is hazmat getting into the groundwater.

    Just 3 tons of fun!!!
    They have also, essentially, banned parting out vehicles. And the laws are written in such a way that even in my situation earlier this year, when I swapped from Prerunner to 4wd, and then sold the old parts... They could have easily accused me of running an "Unlicensed Auto Dismantler." (Which carries pretty hefty fines).
