Rear ended - worth pursuing action?

    1. I hope you never need to, but if it ever applies to you..... its good to ask your insurance company how fault will be determined in the event of a settlement. I hope it goes as you believe it does, but I think what I was saying is something you may want to ask.

    2. I took your claim of 99% to be a reasonable guess, not fact, but because of my experience with how insurance companies settle claims, I thought extra consideration should be given since I disagreed with your guess. I postulated without any proof, reports, spreadsheets, etc. that situations where the driver of the front vehicle was (not licensed, impaired, non working tail lights, reversing etc.) as well as those situations where the persons deciding the claim feel it is not worth it to dispute the statements and find no fault or shared fault were much greater than 1%.

    3. I disagree with your 99% claim, and the way I read your statement that a police report would provide everything the OP needed to achieve a great outcome. That is why I wrote; not to personally challenge you. I wanted to point out that there is a higher chance that the insurance company makes a decision based closing the case asap without looking too far into it. I still believe this happens in non injury cases. You can disagree, the OP can read both opinions along with allot of good advice from others and decide.

    4. Never had a job in insurance, I kind of learned over incidents where I have been involved in collisions with higher stakes like injuries and had conversations with professionals who provided me with their explanations etc. I opened a case with the Texas Department of Insurance once because I felt the insurance company did not act in good faith which is one rule many states have. I found that to be quite hard to prove on my end, but the case was settled amicably and I learned allot about how insurance companies operate.

    What else, yes I have a degree, but not in anything deeply relevant to your statement. It does have to do with math and science so I could argue the math came in on your claim of 99% vs. more than 1% I am arguing, and I applied the scientific method to my statement, but that is kind of stretching it.

    I have let it go, and I have not let it go before.

    I have been sorry I let it go, and sorry I didn't. So many factors and every situation is different.

    The time I was sorry I let it go, is because the person who hit me filed a claim with my insurance so it still became part of the record even though my insurance denied her claim. I believe I was notified years later to that fact.

    The time I was sorry I did not let it go was because it was a young driver, and the damage was minimal. I remember later thinking that the punishment of his insurance going up did not fit the offense.

    had a old lady do the same to me. scuffed the same spot. she paid me cash for replacement parts. then used that cash for a new front bumper. cuz its plastic, and i dont care in the rear lol. #truck

    I wouldn't want something so small on the carfax report. An accident is an accident and looks bad on carfax regardless if it's $500 or $5000. If two trucks are next to each other I'm taking the one without an accident on record.

    I've been rear ended 2 times with minimal damage, and I tapped someone in a drive through. I'd like to think that the guy I hit let it go because of the good karma from me not doing anything to the 2 people that hit me. Mistakes happen, I think you'll feel better in the long run if you just let it go.
