Need help backing out of car sale.

    Read the contract fine print, there will be a section on how to handle this. Look up state laws too.

    If it comes to it, demand the deposit returned - hold firm and state failure to meet the contract and you're unwilling to amend due to loss of faith.

    Finally, the most important matter in all of this, ditch her. She's not wife material. If the combination of both her and a father got into this mess, I can only imagine the poor decisions she alone would try to drag you into.

    If you want to back out you most certainly can, just be adamant about it, but remember to not come off as rude.

    When I bought my first truck I put down a few grand and traded in my camaro. I had the dealer add a tonneau cover and some other things while I took a road trip. Came back, took delivery of the truck and realized they put an aftermarket tonneau, not the stock on that I wanted. Took the truck back to them and they said that the oem tonneau covers weren't offered for the long beds, only short beds at that time. I told them that we were very clear we wanted the oem one and I'm not sure where the miscommunication came from. There was also some other things missing from the due bill and I questioned how could I be assured they performed other things, like the paint protection.

    There were also some things I didn't like when dealing with the salesman. I told them I wanted my personalized plates transferred from my camaro to my truck and they said no problem, they would take care of that. Then got a call a couple days later saying I need to drop a check off for the registration to them and if I wanted my plates switched over I would have to deal with the DMV.

    I told them that I wanted to return the truck, refund my deposit, and return my camaro. They told me that wouldn't be possible since they couldn't take a new truck back and it would be a used truck. After about three hours of dealing with the owner of the dealership going back and forth, all I had to do was sign three or four pieces of paper, everything was reversed.

    Everyone has their unique way to deal with these kinds of crazy situations that pop up in life! And, some of them are even valid! :)

    I take a different approach. If it were me (and I am assuming getting a new girlfriend and potential father in law is not an option, of course), I would implement a private and a public strategy.

    Privately, I would 1) Call my credit card company and cancel the transaction. Depending on the card they will be very aggressive in helping you. I have American Express and they jump on these things right away. Tell the credit card company that you were buying a car and dealer possibly committed fraud and you want to cancel the transaction. Fraud triggers a red alert for credit card companies. 2) I would call a consumer agency in your state, tell them exactly what happened and ask their advice on what process you need to follow -- and what your rights are. 3) I might speak to a local attorney and inform them of the situation and let them know if this is not resolved quickly you will need their services to resolve the situation. 4) I would get out a notepad and document everything -- dates, times, pictures, actions, documents. I would put all of this into play immediately so that you are ready. And, I would not mention any of this to the salesman or the dealer.

    Publicly, I would tell the salesman that you understand they may not have known the car had 2,700 miles on it. You are voiding the transaction. Ask them to cancel and let them know as soon as the entire transaction is voided you will continue to look for an appropriate car. Better to get them to do that without threats while you get ready to put the hammer on them.

    Be clear but kind ... and then have the hammer waiting ...

    Some good advice here, but the best is to think twice about promoting this GF to wife. I used to be married to a woman who, despite anyone else's advice took her any suggestion her Father made above all else. It started-out as annoying then escalated to lots of arguments and later was a large contributing factor in us splitting-up. Tread carefully OP.

    Oh and what kind of car was it? I mean if it was something cool then maybe disregard what I just said LOL!

    A lot of this depends on how technical and aggressive the dealership wants to get. 2700 miles doesn't mean it's not new. In many states "new" means it's never been registered, regardless of mileage.

    Your personal life is no ones business, but from personal experience and seeing the same thing from many others. Don't put any of your own money towards your girlfriend's mistakes. Do your best to help her resolve the situation in every other way, but if she ain't your wife, her lessons are hers to learn alone. Cheers.

    I agree with all of the advice here. Until you take delivery of the truck, you should be able to back out of the deal.

    However, maybe I'm reading the original thread wrong but it sounds like they had what they thought was a new truck earmarked for you, found out it had 2,700 miles on it, and was trying to make it right by swapping it another truck that had 7 miles on it. Before we all dog-pile on the dealer, sounds like they were trying to make it right and the OP's GF just fails at life :spending:

    Op, the contract is void due to the fact it was stated to be “new” and a vehicle(in Pa anyways) must be below 500 miles to title as “new”. The vehicle has already been titled A and will now be a B title(2nd owner). Back out and tell them to pound sand.

    So they're going to fix their mistake by giving you what you want?

    I'm not sure what the problem is here. You wanted a new car. They tried to give you one with 2,700 miles. You likely said, "hell no". SO they find one with 5 miles, and now you don't want it?

    Am I missing something?
