Car and Title in Florida BUT Owner in California?

    Hey all,

    Got a bit of a problem and looking for what might my options be.

    Issue: My sons Car 2008 Toyota Corolla is here in Florida at my house. My wife
    has been driving it for over a year since He has moved to California.
    She was having trouble driving it because it's a 5 speed manual. So we decided
    to get her an automatic. so we just got an 07 Corolla. titled in my name.

    The problem is my sons 08 is in His name. What are the options to try to sell the car
    for him? Does he have to come all the way to Florida to try to sell the car ?
    Or is there some other arrangment that can be done at DMV.
    Like maybe gifting the car to me. Or mailing the title to him to sign and return to
    me to sell the car. just an example.

    Have your wife sign his name on the title :spy:
    Or mail it to him priority and have him sign and send it back. Write out a bill of sale for him to sign at the same time if your state requires it.

    All of these suggestions sound reasonable. Cheap power of attorney on legalzoom. If needed of course.

    Mail title. Be sure to use registered mail both ways, because that way they won't lose it.

    You need either limited Power of Attorney to sell the car or get the car titled in your name.

    Don't jack around trying to forge names......it can come back to haunt you in a nasty way.

    Simplest is to have him sign the title over to you. Check with the DMV/MVA you may be able to sell it as abandoned property.

    Well I've looked into what has been said here. Thanks to all. The power of attorney
    I saw was for both parties in the same state. I have not seen a form for out of state to in state.
    A few hoops to jump through are the 2 witnesses having to be present during the notary signing.
    The car can be gifted to me from him : I have to pay the title transfer and tag .
    No tax or selling price. Now that said he will be coming back here in a few months during mothers
    day (week) And we can go to DMV then and take care of this. Even he said it might be better that way.
    It gives me time to get the car ready to be sold. It needs a good cleaning and a few small things fixed.
    Nows about the right time for me to be riding my motorcycle, not working on this car all the time.
    So to be able to spread out the work to be done over a few months will help greatly.

    A few OE parts from fancy trucks
    In Fla the title only needs the sellers signature, non-notarized.

    You can mail it to him, he signs (no dates/prices/etc) and he mails it back.

    When you sell the car you provide the buyer the title, complete the seller section, type up a receipt and send them on their way.

    Since we have no inspections or such to jump through, it's pretty easy peasy. And the cheapest way.

    A limited purpose POA as suggested is a fine idea if you want to spend the $ / effort to jump those hoops. Out of state is not an issue if you use a real lawyer. We've had others authorized to sign for us at real estate closings, etc., many states away.

    Or you can pay me per diem gas/food/lodging to drive it to him and fly me home, then he can handle it as he wishes. :D

    I cleaned out the trunk today and fixed the wing on the trunk lid. Vacuumed out
    the driverside interior , cleaned all the driverside door jambs, Compounded the
    driverside sheet metal, then put a light wax on it. It was getting a bit chalky .
    Now looks much better. If the rest cleans up like this I may be able to be in the
    $2500 asking range . 2008 1.8 liter 5 speed manual , everything works. 154 K
