Rust

So I recently purchased a 2007 Toyota Tacoma, about 2 weeks ago. The frame was rusted completely as known for those model years, but was spray painted black and seemed to be undercoat until recently when it started chipping away. The class action lawsuit against Toyota said you must take action within 12 years of model year, which means it is now too late. Because the dealership most likely spray painted the frame and sold it as drivable and good condition, is there any legal action I can take? Or am I screwed?

 

Well, what's the paperwork have for language? Any 30 day dealer warranty or anything? Document and bring up with toyota and dealer immediately

 

Also, pictures. If you have spray paint, and takes pics and whatnot I'm sure there are avenues you can take with varying levels of success

 

Did you buy this at a Toyota Dealer, or used car lot???

are you sure it's not the CRC coating they applied?

I know I took my 2010 in for the recall and they said the frame rust was not bad enough to do a whole frame replacement. Instead they opted for a corrosion resistant coating (CRC) on the whole underside.

They determine "bad enough" by doing a perforation test. If the work was done by a dealer, then it would be documented for sure.

 

And you would ask for this advice from a forum full of strangers because?????

 

And just what in the hell is a perforation test ? - stick your you know what, through a hole??? - Like the frame will heal itself over time? Someone explain to me how the CRC coating will restore a rusted frame...Even with sandblasting which won't happen, will not correct the issue to my satisfaction. They are just going to spray a bunch of 'hokeus pokus' just to make you go away.....Demand a frame replacement & threaten them with a DMV complaint.... Slime ball car dealers.......

 

Couple of questions......
You bought a used truck from a dealer....correct?

How do you know the previous owner didn't spray paint the frame to pass the truck to the dealer?

Conversely....
How do you know the dealer spray painted the frame? Do you have any proof?

My point. You could be pissing up a rope.

You should get a copy of the service history from Toyota. It might hold a clue.
Unless you have a written warranty from the dealer. Used cars are sold "AS IS".

 

Chipping doesnt mean perforation, and it doesnt matter, its black and white 12 years, no one is getting a pass. It's not a recall, its a class action lawsuit.

Sharing pictures will help us lead you in the right direction.

 

they gently tap the frame with a hammer to see if any holes appear. If your frame is rotted to shit BUT doesnt have any 10mm or larger holes they deem it "good" and spray it then send you on your way.

 

I would take a good hard look at the frame, a rusted frame will not pass a state inspection in my state & if a dealer slapped a sticker on the truck just to sell it, then they have a problem & need to take the truck back....You still didn't answer the question where you bought the truck, based on what I'm reading its Not a Toyota dealer as they would not take the liability of selling a truck with a rusted frame....In any case I would put my efforts in returning the truck...Keeping it will only be problems down the road.......
