Hey everyone, I got rear-ended yesterday by an uninsured driver. I'm trying to go around paying the deductible. The damage isn't bad, I'm looking for the right side mounting bracket and the panel. If anyone has something for sell lmk.

Take the peckerhead to small claims court.

No reason to pay for the damage the other driver caused.

Judge will likely award the damages and court costs to you.

I assume you have a Police Report and the other driver's name. If you go to small claims, you'll need the Police Report, all pictures of the accident scene, your damage estimate/repair, any witness to the accident.

    I added a bolt once...
Great... Happened to me when I had my 2006. Took the $700 insurance money for the bumper and lived with the small dent.

Problem? When I bought my 2014 a CarFax was pulled on the 2006 and listed "accident". No further details. I sold PP but it hurt resale.
    I hate CarFux.

Yeah, thats what I'm worried about, I don't want it to show, but the parts are probably going to be more than my deductible.

you might also need a new back up sensor and blind spot monitoring sensor.

Yeah, its inconvenient. But if you let the other driver off the hook, then they have no reason to ever have insurance. Who knows maybe the next impact caused by the other driver will be serious. This will be a lesson that insurance is less expensive than paying for an accident.

Called the police, her car was towed and she was fined. But unfortunately that doesn't help my pockets. Even if I take her to small claims court does that mean I'll get paid?

That can be used as evidence to prove your case.

As a defendant, she won't have much defense.

I've been to small claims court twice and "won" twice. Ask me how much money I've gotten from it.

Your case could certainly be different, but...
IMO, reasonable people are apparently the only ones that will pay when they lose in small clams court.
Do you think a person that rolls around with no insurance is a reasonable person?

In this state you can file your judgement with the court, the sheriff will help sieze some of their property to pay you.

When I was in a collision years ago the other driver had no insurance. I paid my deductible, the insurance went after the other driver and told me when they get paid they will pay me the deductible. Never heard a word from the insurance company after the claim closed. Fast forward 15 years and I get a text from my sister saying my name is on the government unclaimed money site , I was curious so I contacted the site and after a little paper work I got a check for 700 dollars covering my deductible.

You can easily get a judgement in small claims for the cost to fix your truck. Odds are the person driving uninsured is going to be 'judgement proof', meaning they have no money or resources to go after to collect your judgement.
