    Things like this happen pretty often everywhere. If this person *truly* was in the hospital, sick, hurt, etc... you are going to feel horrible later on. So, it's been 2.5 weeks and you're out $800.
    It's $800. Bright side: You aren't on the side of the road without wheels, car's not stolen, etc, etc, nag, nag.

    Personally, I've been waiting on both Binance, and Coinbase for *just* a few thousand for over a year or so now. It's probably worth more than 10 or 20 times the amount sent. There are a few hundred thousand people doing the same.

    Hope your resolution is peaceful. GL and try to be patient. Just gotta play the long game- karma truly exists!

    Depends on state, I can say for sure in Massachusetts this is true. It is also true however in MA that winning the case is easy but getting collection is quite another at times..

    This is all true re life happening, but the fact that the seller had the time and ability to block the OP's number and shut down their Facebook tells me they had time and ability to at least reply quick if they were incapacitated

    If a judge has issued an order against a defendant. The defendant refuses to pay, there are legal paths available. IIRC, you need to speak with the court about the procedure. In a nutshell, the court can order wage garnishment, leans, selling of assets......to allow restitution to be fulfilled.

    True; again, depends on state. Sometimes you need to have them served by a deputy or marshall and that cost is borne by yourself.

    Yeah no feeling bad on my part if he’s in the hospital…..at all. We all have phones and are connected 24/7. We are in 2021…..excuses like that don’t fly anymore. Dude has family and friends that can help him out in a time of need if he’s truly incapacitated. His minimal day-to-day affairs can still be taken care of. I know the bill collectors aren’t gonna be listening to his excuses without him having to go through a ton of explaining and pleading for extensions. Example: in a recent local news story, the Harris County appraisal district didn’t pay attention to a woman’s voicemails and emails she left saying that she needed an extension to pay her property taxes due to her husband’s untimely death….even after showing proof. It took a local news station reporter fighting on her behalf to have an extension granted.

    The simple fact is he did an honest deal in person with another member and has my $800 in his pocket and isn’t gonna give it back. You don’t block my number (and lie saying that you didn’t), shut down your Facebook, stop replying to PMs on here, tell me your phone can’t be around medical equipment (writing me that *supposedly* in the hospital, etc), etc. all while being sick. It’s just another one of his lies.

    The update is I accepted 5 minutes after our phone conversation over 2 weeks ago that my money was gone, but that doesn’t mean I’m not going to give some effort to try and re-coup my money. I’m not going down without a fight.

    Exactly. He had time to block, shut down FB, etc so he had time to get in touch with you if he were an honest person. Plus if doing those things in the hospital it further disqualifies his claim that he wasn't available (IF that hospital thing was true anyways).

    And definitely. Spread the word far and wide as well. Absolutely.

    Don’t give up. $800 is a decent amount of money and worth fighting for. Even if the money doesn’t matter to you try to stop this guy from scamming someone else. I’m sure you’re not the first one he’s done it to.

    Knute is 100% correct. I have done the small claims court half a dozen times… I f’ing hate deadbeats, anyway, if you can locate the guy and serve him the burden of proof is on you and your word isn’t just going to carry any weight in court, you have to prove it with documents. Text messages may or may not work… what you can do is attempt to trick him into admitting that he scammed you. Something to the effect of he promised to sell me 6 tires at $500 and if he is an idiot, his answer will be, no I didn’t, I promised him 4 tires for $300. He is toast after that. People are idiots sometimes. If he doesn’t show for court you win by default and you get the court to give you an abstract of judgement. You file that with the county clerk to record it. Any property he owns in that county now has a lien on it. This where the fun starts… you ask for a judgement debtor exam(JDX). He may or may not show, if he does, you will be in a room with a judge pro tem, temporary judge, and you ask him where he works, how much he gets paid, his SS#… that is THE important bit of info. You ask the judge to have dude open his wallet and empty his pockets. Any and all cash is now yours. If he has any credit cards, you instruct the judge to have the bailiff walk dude to the ATM at the end of the hall and take out as much $$$ as required. The bailiff is usually a pretty big guy with a vest and gun… if dude starts whining, bailiff doesn’t give a rats rear. If dude doesn’t show, most states allow for an arrest warrant to be issue for a FTA, failure to appear, serious stuff in most states. Dude is out friday night with his hommies has a beer or 2 and get stoped by a LEO… they check for wants and warrants and guess what, dude has a warrant… he gets arrested and spends the weekend in jail for his FTA, his car gets towed and impounded and now he has to explain to a real judge why a: he is a deadbeat, b: why he blew off the JDX. c: why he ignored the whole proceeding.

    if after all of this all of this and you cant find the guy, you can forgive the debt and send the state tax agency and the IRS a 1099 for the full judgement amount. When he does this the taxing agencies will match the 1099 and his SS# and say hey, this doesn’t match, you owe us X number of dollars in fines/fees/penalties because you didn’t declare all income, tax agencies do not forget, ever. I don’t know what this guy is thinking but he should rethink the time he thought he thought he could screw over a Tacoma World peep.

    All of this is accurate, I went through every single one of those steps a couple years ago. Took me about 14 months working by myself with a process server to get all of those things done. And then the day of the Debtor's Examination hearing I got a certified letter from her bankruptcy attorney. :bananadead:

    I had this happen to me over $600, I found out where he worked and called his Human Resources dept, told him I was doing so, then he decided to pay. 3 months later I went by his house on the way to a Clemson game to see if he would like to talk about it all. He didn’t. Why did I do that? The last message he sent me after paying was that I better pray we never meet up. OP, best of luck, hope it all works out for you. If you can find family and friends, embarrass his sorry a$$. Make his life miserable. You have his number, sign him up for gay porn text alerts! Make fake Grindr ads with his info. Get busy!

    @Drabon74 I would counsel against playing the "get even" game. It can backfire on you in a bad way. You don't want the debtor to become the victim.

    Just follow the legal system. It has more PUNCH on someone than signing them up for gay porn. Remember, your out of middle school.
