Shipping Delays and FTC Law

    So while I sympathize with the shipping delay situation for many vendors, the fact that they are taking full payment is starting to irritate me. In most cases I am pretty flexible and okay to wait a few months. In one case I was not and now I want a refund and they are saying not without a significant restocking fee. I am going by these rules

    Am I wrong? Full refund is full refund.

    Item was ordered Sep 9th and expected Oct 14th.

    If the vendor states in writing there is a restocking fee there's nothing really you can do. I've seen written "full refund" with a "xx% restocking fee" . But how you can be charged a restocking fee on something that was never shipped is something i would fight. Unless they call it a "processing fee".

    In a situation like this, I wouldn't hesitate to contact your credit card company and dispute the charge. They'll almost certainly rule in your favor and you'll get a full refund.

    This is why I use Paypal. They have never failed to back me up (and refund) when faced with shady dealings by internet vendors.

    FWIW.....

    Restocking is only when the customer has received the goods, then returns the goods.

    No restocking happens if you haven't received the product. The item is still in the vendor's hands.

    Contact your CC to dispute.

    CC updated and refund issued. No word from the vendor which is a shame since they have been blasted here on the forms before and I would think they would want to be proactively improving their customer service reputation.
