None of us were there, so we can only comment or provide suggestions based upon the info OP has provided. Some valuable scientific info has been provided so far that proves selective yellow fogs are in fact DOT/SAE approved and legal when aimed properly. The issue is whether or not traffic laws in OP's residence had stipulations for fog use. However, given the stated weather conditions and time it would be hard to argue the circumstances weren't legal for fog use.

I don't see the relevancy of your story about the "stop" you made, but it sounds like you're in law enforcement and your emotions or your reaction to the other parties emotions determined the outcome of that "stop."

I could share random off topic stories about my HOA that makes up their own rules, selectively enforces them and then claim that people in positions of power abuse their authority, but I don't see the value of it for OP in this thread.

Do you have any legal knowledge of said statutes in OP's residence that would benefit his current situation? Maybe something pertaining to your suggestion that fogs were on with parking lights? Seems like a legal stretch to me to argue fogs are headlights, but I don't know all the traffic laws in OP's residence.

OP, it seems like a very weak case, but I would still recommend consulting with an attorney. Consultations are usually free.

Apologies to anyone that may have been offended by my posts in this thread and Good Luck OP in whatever you decide. :hattip:

Sorry i havent touched base. But, i got it dismissed today. Small town municipal court. it basically went like this-- Went to court. When they called my name I went up and he asked what was the improper equipment for. (The citation was written for improper equipment, yellow headlights) I said it was written for yellow headlights, and I do not have yellow headlights, I have yellow fog lights, that meet the sae standard j583 for street legal fog lights, and the Oklahoma statute for fog lights doesn’t say anything about color. He asked a little about if they are wired factory to only be on with the low beams and off with the lights off… I said yes, everything is wired into the factory plugs. He asked if it was foggy, I said it was 4 in the morning and raining. He mentioned he thought the statute mentioned they can only be used under proper conditions.. but it had been a while since he looked at it. Then he jabbered on about some other stuff in the statute about how a lot of people running around in big jacked up trucks, their fog lights are no longer legal, because they are higher than the law allows... etc etc.. and then he dismissed it with no cost. I just made the post to know if anyone had every run in to such a thing. But it saved me 140 bucks. thanks for the information to those who provided it.

    Good work sir.

Did the officer show up or just you and a magistrate/judge?

Just the judge, a secretary of sorts, and one officer, but not the officer who wrote the ticket.

Ahhh wasn't sure how that worked. Would have been nice to ask the officer what statute number they referenced.
