Wife hit my truck with our van. Report to insurance?

Turn it in as lot as she hasn't had a lot of other accidents or tickets. It doesn't matter who she hit. People back into their own cars in driveways all the time. My neighbor's wife has backed through their garage door two or three times. Some insurance companies advertise accident forgiveness. Depends on the company and how long you've been with them whether they raise her premium.

 

it would still be considered an at fault accident and it can still raise premiums even with “accident forgiveness”.

 

Maybe it depends on what state you live in. Aren't some states no fault?

 

Nope. Just get it fixed and move on.

michigan is often referred to as a no fault state. that determines whose insurance company pays for damages in certain accidents. however, fault is still assigned to the actual operator of the vehicle.

You damage your own property. You fix your own property.

 

you’ve violated the contract of good faith you have with your insurance company and yes, we consider it fraud. it is grounds for cancelling and/or non renewing your policy. it will also become part of your “insurance history” that other company can also see if you shop around. boom.

 

That makes no sense. Insurance companies don't ever want to actually pay out. They're more than happy to let you pay out of pocket instead of them.

 

I'd think that 'good faith' and contractual obligations are pretty wibbley-wobbley. Do you have any actual citations of cases where the insured didn't ask for anything (ie, no benefit, to use the legal term) from their insurance company and was charged with fraud?

 

Um… the point of insurance is to ensure financial responsibility for damages. The item insured should be kept in good condition. If the owner damages their vehicle and decides not to repair it then claims that damage as part of another incident then, it would be considered fraud. To repair ones own vehicle without involvement of an insurance claim is not fraud because the financial responsibility was assumed by the owner.

 

no necessarily. damaged/repaired vehicles impose a future risk to us. who is doing the repairs? are they qualified? is the vehicle going to be a future risk to us because it wasn’t repaired correctly? this is why vehicles with prior damage can cost more to insure, only you may not know it.

 

there is no “charge” because it’s not criminal. but yes, we discover this type of fraud all the time, after the fact. and yes, it does impact the two-way contract of good faith. and yes, we can act within the scope of the states’s laws and take action. even if the insured wasn’t trying to gain anything. this type of fraud also demonstrates a possibly future risk with these customers.

So your saying she hasn't offered to pay for the damage?

 

That means every body shop that does a non cosmetic repair for cash is an accessory to fraud.

And any mechanical shop, including dealers, who perform repairs from damage (like bent suspension from curb strikes) for cash are also accessory to fraud.

Please, shut them all down. They are wrecking the good faith of insurers from professional wallet picking.

I think what bugs me the most is the industry using the term fraud, when it really isn't fraud in any legal or meaningful sense of the word. What it sounds like from here is that they're using the blanket excuse of "fraud" because the industry is too lazy or dishonest to just come out and say, "we think you're skeezy so we're going to drop you".

 

In other words every little ding and scratch lights replaced needs to be reported to your insurance.

We all know or should insurance is a company by company state by state ! It is possible some company that only deals high end vehicles might look at things like this. Just saying!!
