2022 Tacoma TRD Off-road rear ended-- No diminished Value??

    My new truck rear ended while I was sitting at a stop light. I've got around $3,000 worth of damage according the body shop. The truck had around 8,000 miles when it was hit. It's a 2022 4x4 crew cab TRD off road.

    The owner of the bodyshop told me the insurance company definitely owes me diminished value.

    The insurance adjuster just sent me a worksheet that said there is no diminished value. It's even more frustrating because this is the insurance company I've been using for our vehicles.

    When I go to trade the vehicle I won't have a clean car-fax. I definitely think this wreck diminished the value of my vehicle. This is the first time I've been through this. Any advice would be appreciated.

    The insurance company will be of 0 help in a DV claim. They will try to obstruct and hinder your with lies and bullshit.

    The person that hit you or their insurance company is who you go after for diminished value.

    Different states have different laws about DV claims. It will be a battle to get DV in most states. I live in California and they denied my DV claim on my BMW a few years ago even though there was over $20k in damage. I spoke to a couple of lawyers about it and, at that time, they said there would be no way to collect on DV as the state did not recognize it. I lost about $5k when I sold the car because of that. I wish you all the luck!

    That’s why I dislike carfax, I had the same thing happen recently on my 2021 RAV4 getting rear ended. When I went to trade it all I heard was it has a carfax report for rear bumper damage so the value takes a hit. Yet I see cars that a wholesale friend of mine scans and it shows clean even though we know it definitely isn’t. I have never heard of anyone getting anything extra for diminished value even though there definitely is evidently when you go to sell or trade.
