State of CA says Landlord can’t refuse to renew lease?

    Got a real estate/rental question.
    My mom has two houses on one lot that she rents out. Back in September 2022 my brother decided he wanted to move into one of the houses so contacted the tenant and informed him his lease would not be renewed(lease is up next week), so today he goes by the house and tenant says he’s not going anywhere and doesn’t legally have to, brother contacts lawyer and lawyers agrees with tenants, unless there is a valid reason such as unpaid rent etc lease has to be renewed. Does this sound right. Of course this is CA

    Nope can’t raise the rent and thanks to my sweet but naive mother it’s about 1200.00 below average for the area

    CA has some weird laws that typically favor the tenant. Quite useful as a tenant, not so much so as a landlord trying to rid themselves of a tenant.

    CA leases typically are one year initially, then turn to month to month. Terminology in there typically requires tenant to give one months notice before move out, and I believe 60 days for a landlord to end the lease.

    Legally there must be a way to end a tenancy. Would need to know more about the situation, what the lawyer said, etc. If it was me, I would start reading up on CA law. Does time in the unit grant special statuses in regards to eviction? Then I would contact a different lawyer for another opinion.

    If you move it into a trust with each of you owning a 1/3 you may be able to move them out in awhile as an owner can move u to their own home. You can raise the rent but likely no more than4%.

    Google says that even in California it goes to month-to-month after the lease expires, at which point the LL can provide a 60 day notice.


    But that's Google.

    Your mom, the property owner, would have to be the one to consult an attorney to get the straight facts.

    I wonder what happens when the property is sold.

    Does the new Buyer need to honor a lease in the tenants favor.

    Everything went crazy with Covid.... laws keeping landlords from evicting even for non-payment. People living for free for over a year and nothing can be done. I THINK that law expires very soon.
