Diminished Value claim on New Taco

    I own a 2019 Toyota Tacoma TRD Sport and I’m active military which plays into my DV question. I was hit from behind in the state of Georgia while visiting family. The other party was 100% at fault and the truck has been fixed properly and returned back to me. Their insurance ( progressive ) took care of all the fees. It had frame damage and rear bumper / tow hitch damage. Anyways, I’m going to file a Diminished Value claim because I obviously loss some $ value due to an accident being linked to my 4 month old truck. My question is, I heard some states don’t support DV claims and I’m not sure where I fall under when it comes to the state. My home of record is Georgia as a pay GA state taxes there, I serve active duty and live in Missouri, and purchased the truck at a dealer in Kansas. When it comes to my claim, what state do I fall under? Am I able to do this? What is your experience and do you have any advice for me?

    What state is the vehicle registered in? I assume you have a policy in Missouri or Kansas. Check out those laws first.

    What insurance company do you have? If you have USAA, you could try and get them to go after Progressive.

    The truck is registered in Missouri and insured through USAA but, I didn’t go through my insurance for the accident claim and I’m not going through my insurance for a DV claim as I believe it’s the at faults insurance who should be responsible for something their insured did. Accident, repairs, DV claim, and all.

    I maybe wrong. but if everything is already settled (closed out/paid) you may be screwed, on DV. Doesn't hurt to try. Call your INS.

    USAA is pretty good at providing guidance. You may be able to get direction and advice from them. They have always helped me out when just looking for general information.

    A structurally damaged vehicle that was repaired is worth 30 to 70% less than a undamaged one. That would be the range of value of the DV claim but if you already signed off on the repair then you assumed that liability and are SOL against the at fault insurer.

    Diminished value claims aside, it sounds like things worked out for you. However, your didn't be against going through your own insurance for future incidents. If you file with your insurance, then you'll get the deductible back if they collect from the other party and you get the advantage of having your lawyers work with their lawyers.

    I'm dealing with this right now. You have to do most of the leg work yourself or hire someone. I hired an appraisal company to inspect my truck and draft the letter. I submitted the claim, but haven't heard back yet.

    The DV claim is a completely separate claim that has to be claimed post repairs and can be claimed up to 2 years since the date of the incident. I’m not SOL. This is how DV claims work.

    I have not ran my own report, but since the insurance has indeed paid out for damages fixed by a repair shop, it will be on Carfax.

    I have done loads of research as I’m sure you have as well. I already hired an auto appraiser to tell me the pre and post values of my truck so that is being done currently, once I have the appraisal, I’ll call progressive and file the claim and send them the certified DV appraisal

    That is true. I feel adjusters working with adjusters make the job easier as they know their own processes, but this is my first incident so I’m learning the process as I go, but I’m going in knowledgeable due to people helping me and such.

    Sorry for reviving old thread, but I'm in a similar situation and would appreciate how this worked out for OP. My 21' Trd sport was smoked while parked and collision appraisal is $6k, he missed the frame and trashed the quarter panel, bumper, and tailgate (truck that hit me was pool cleaner so handles sticking out of bed). Curious to know if your DV claim was settled and how you went about collecting info for the claim?

    Get ahold of Collision Safety Consultants. They do this kind of thing every single day.
