Legal issue - warranty not being honored (NC specific) help needed

    I'm looking for an attorney in NC to work with to have a dealer honor the warranty that they 'inherited' when it bought out another dealer. When the dealer was bought, it stated that the warranty transfers and money was also escrowed for future repairs. The 'new' dealer flat out refuses to honor the warranty and I need assistance. My legal plan is allowing me to go outside their attorneys if I can find one to work with. Thanks in advance.

    Is this via 3rd party?

    If it's a 3rd party service contract provider (extended warranties do not exist as warranty is implied as coming with a product for free from the manufacturer, service contract is the correct term), I would simply contact that 3rd party.

    The way the service contract works is, they have an established amount to pay the service department. Unfortunately it can be less than the labor rate the shop normally charges customers but again, this is all negotiated with the service contract provider and the dealer principal for that dealer. Having exchanged hands, the new dealer isn't obligated to fulfill said contract (at least in CA and many other states).

    Just go through an SAE-certified shop.

    Again, this is assuming it was a service contract purchased on top of the vehicle (whether at the time of, or at a later date). Should read the details of your paperwork you signed.

    This was a dealer supplied warranty for all vehicles they sold. Not a third party.
    I’m looking for an attorney - this dealer has a horrible reputation and legal actions all that will ‘move them’.

    Interesting; I'd be going after the dealer principal of the dealer that sold the vehicle, not the new owners.

    Fair that they'd be better backed in that regard, anyway hope it pans out well for ya.

    OP, there's better places to look for legal help. We can tell you what size tires will rub, or argue over oil change intervals, but thats about it.

    I'm just not seeing toyota motor Co offering a warranty on a 2014 vehicle. 99% of the time they contract it out to a 3rd party

    Usually based in Florida for some reason lol

    To answer a few questions - the dealer's name is on the warranty/agreement. It is a quite sweet warranty covering even the water pump and fuel pump. And there is a detail that states that the dealer does not have to perform the repairs if the engine or transmission failure causes the vehicle to not be driveable.

    :popcorn: I don't live in NC or know any lawyers in NC that may give you proper legal advice. Good luck. Hope your legal fees don't exceed the cost of the repair you need to get done.

    This being not an ambulance-chasing personal injury claim with prospects of a large payout, the lawyer will likely require fees paid upfront.

    Is this a Toyota dealership or private dealership? There is a big difference in applied warranties between the two.

    ARB Bumper, SOS sliders, SOS rear bumper, SOS skid plate. OME Lift. Some other stuff.
    Lawyers aren't cheap. That must be one hell of a repair bill.

    Toyota (nor other manufacturers) concern themselves with a dealer's inner workings for instance, this "service contract" they provided :burp:

    You need to call Ice T, or Angela Bassett. I can't see anyone honoring any warranty on a ten year old vehicle. Cheapest long term solution would be to trade the 24 on an in stock 23 Tacoma, and forgo any add on warranty.

    ^Some dealers during certain times offer a "lifetime powertrain warranty" at the dealer only, if you buy the vehicle from them. Some have strings attached like requiring all maintenance done there. The OP may have spent a lot on overpriced oil changes over the past 10 years to maintain this warranty.
