Advice on unhinged pool maintenance guy

He is not going to get your house, but good luck finding a good pool guy.

I just paid a bunch of money to have the pool ripped out of our yard because I wasn’t gonna pay the ridiculous amount of money to keep it clean and full of water here in California.

Plus, we have raccoons, and after two of them drowned in our pool, my wife was done with it.

 

They love to swim..
Nothing like showing up and the raccoons have had a party, only thing worse is the wind, rain and fucking ducks.

 

I know he can't "get our house" but he can certainly force us to spend money on a lawyer if he actually goes through with it. Just not something I need to deal with considering we paid him. I don't know why the guy hasn't deposited the check yet.

 

If his bookkeeping is a shitty as you are implying, even if he went to a lawyer, they’re probably telling him he’s going to have to provide very detailed evidence that you didn’t pay him. A bunch of crumpled up Taco Bell napkins with numbers scribbled on them aren’t invoices.

Furthermore it’s very difficult to go after people for not paying in California. I’m not implying you’re a deadbeat, but if he knows what’s good for him he should just cut his losses and leave you the hell alone.

He’s going to spend much more money to get whatever he thinks you owe him.

He has to also provide evidence that he used registered mail or some other official courier to attempt to get an invoice to you and get proof you received that invoice to even get this party started.

 

You said you owe them $650.00 small claims no attorneys get involved. You go in front of a magistrate and they see evidence and hear stories and rule. Judge Judy stuff.
My opinion:
They have not contacted you in how long. Judge rules in your favor since they aren't very concerned about cashing checks.

He was talking smack to you, to scare you and succeeded apparently.

I've been around long enough to know that people talk sh*t all day every day, hoping the fearful will just give it up; unfortunately it works way more often than it should and incentivizes the crappy behavior. Only a handful can actually back those words up with actions; your former pool guy isn't one of them.

I would have insisted on a formal mailed final invoice before I paid that lazy fool a dime; it isn't like your pool was sparkling clean . . .

IF you ever get some registered mail from him with an invoice, then you can deal with it.
Till then, this fool isn't worth your time or energy.
