    I just went through the lemon law arbitration directly with Toyota, no reason to go the attorney route, really no benefit to it, you got nothing to lose if you wanna start the process, PM me if you want more info I’ll give you my number and we can talk…
    I got myself a do over, they bought back my Tacoma

    30 business days is relatively close to 30 calendar days. The service department is only closed Sunday so you’re looking at about 35 days from the failure. I seriously doubt they are going to have the truck back like new when the clock runs out.

    In the meantime, I would be interviewing Lemon Law attorneys and getting ready to defend your rights.

    It’s not always 30 days, it’s about an unreasonable situation…
    Brand new truck needing an engine sounds pretty unreasonable to me…

    Engine blows on day one is the definition of a lemon in any reasonable persons book. Toyota should already have a new truck on the way to @BronzoTaco. This case will be a piece of cake for an experienced Lemon Law lawyer.

    Go after pain and suffering, too! :D

    Lemon law in most states is 30 days without the vehicle due to a needed repair. The law is cut and dry.

    Truck could need a basic repair but if it stops the vehicle from being used and even if the OP gets a free loaner, 30 plus days qualifies for lemon law.

    Im in california, I complained about my ac twice & my paint issue & the law states paint defects are not covered by lemon law....
    Vehicle was in the shop maybe 4 days total...
    No repairs performed....
    Toyota bought it back, under the "lemon law"...
    You discuss with an attorney they will explain, it doesnt always have to be 3 repairs / 30 days to qualify....
    Its just an unreasonable amount of times for a new vehicle, to the person stating the case & making the judgement...

    I know my career dealership / brand would be rolling the OP into a new vehicle in this situation ASAP....

    I think the new law went into effect 9/1/2024. It certainly changed recently.

    It is much more manufacturer friendly now. With Toyota USA and Tesla headquarters now in Texas, it doesn’t surprise me.

    Another update: The crate motor thing was obviously nowhere near true. The way I interpreted the conversation was that part kits were being sent and they will rebuild engine in house. Out of all the parts he mentioned (I'm no mechanic so some things I never heard of) he failed to mention a new engine block, which led me to believe they were replacing all mentioned parts on the current block. BTW.. 2 mechanic buddies advised me to insist they replace the turbo and make sure everything else that oil went through. I did confirm turbo on order. I was contacted by a little birdie soon after my telling them how I felt about a new truck with a rebuilt motor. The birdie told me that they are replacing the entire motor, block and all, but it does not see it getting finished in a timely manner and said motors are on back order with other parts. We touched upon a solution and it was definitely in my favor but that is just talk right now. My mind was a bit more at ease after the conversation but time will tell. Just trying to be patient and save the fight in me for when I really need to. I thank everyone for their input and help. Being out here has made the blow a bit easier. Just pisses me off that the weather is now perfect in Southern Utah and I'm going to miss the good part of this season not sweating my ass off being outside. There's always (maybe) next year!

    The intent of the lemon law is to protect the consumer from being screwed by the manufacturer/dealer. If they provide a Tacoma as a loaner while your Tacoma is in the shop that's a pretty reasonable solution while repairs are completed. Effectiveness obviously depends on interpretation of what "comparable loaner" means, ie, not a 2wd SR in exchange for a TRD Pro.

    Im just talking from my ford experience & background...
    I new crate motor is usually available for these low mileage situations...
    BUT
    Since theyre still trying to build these trucks to make theyre profit, keep up with demand etc...
    Such an early release, a new long block probably isnt readily available in the parts catalog & the dealer was advised by toyota to order a head & a shortblock, & all required casualties, cams, can gears, anything that oil has flowed through it....
    Their plan may change numerous times during the order / waiting process until your parts actually stick & show-up...
    They may order a ton of parts & just 1 unavailable item suck as an oil pump isnt available in the catalog for the application & theyre dead in the water for 6+ months until they acquire the part...

    If youre able to roll into another vehicle, take the opportunity to....
    You paid top-dollar for a nice truck & now its getting all hacked-up, right from the get go...
    Thats my 2 cents...
    You will get ALL your money back, including funds for any mods that you may have done.

    Hopefully the little birdie works at Toyota Corporation. You should ask for an email summarizing the conversation. You should definitely write concise notes while they are fresh in your mind. Call date, time, duration, contact person name, phone number, what was discussed, promises made, contingent factors, etc.

    This is true but if nothing else it's on them, why should OP help them along?

    It does seem a tad strange where they're making those whole motors right now to install in trucks on the line and can't get one out to you..this isn't like looking for a motor for my 2010 as I see it.
