    There was a similar thread not long ago. Someone in AZ had a buddy that was doing time after he caught a thief, went outside to confront, and wound up killing the thief. Even if completely legal, you still have to survive the courtroom. In that guys case, he lost. Sounds like the key is that he went outside to confront them. Had he stayed in the house and yelled at them to leave while he called the cops, he'd be a free man. I think that's the right course of action. If they try to enter your house things change dramatically. You do not want to be in front of a jury for shooting someone who's only crime was stealing your stereo.

    laws are different in different states...

    here in OH, you can use "deadly" force if the following conditions are met:
    1) you didn't cause the incident, i.e. instigator..
    2) reasonable and honest belief you are in immediate danger of serious bodily harm, or death.
    3) duty to retreat, unable to avoid confrontation w/out danger to yourself or others.

    ..in addition, we have a castle doctrine law, that essential removes the "duty to retreat" when in a lawfully occupied residence or vehicle.. there is also a rebuttable presumption of self-defense, where the prosecutor has the burden of providing evidence to the contrary..

    ...

    so, a thief/thug/scumbag trying to steel something outside can be tricky, ..some say it's best to avoid intervention altogether,... but there's always a "what if i" ...somehow try to stop them... it could be very dangerous to try because, other than yelling at them from afar, ..you'd probably have to get up close... as far as sitting on your porch aiming a rifle at them, ..i don't know, but i'd think that would be a big no-no in most cases... sometimes you hear stories of people stopping and detaining thieves at gunpoint, ..but i think this is largely discourage in the self-defense community, ..too much risk of being falling victim to other laws that generally prevent you from doing that - brandishing, menacing, unlawful detention, ..etc..

    ...basically the rules of engagement (ROE) for cops and good-guys is lopsided when you consider the "lack of" ROE by the bad guys, ...they always get to make the first move, unfortunately..

    If you are in fear for your life, then you can use lethal force. Now...If a fluffy bunny comes into your house, all teh while telling you "I will not hurt you, I wish you well", then procedes to steal your TV....well.......You better stop doing whatever drug you are high on.

    i would think so in all but the most communist of states... ;) anyone inside your home, unwelcomed, or through breaking/entering is a tremendous threat (no questions about that IMO)... everyone's heard the horror stories of home invasions where one, or more, thugs/scum/excrement break down the front door and rape/torture/kill, etc. the victims..

    - always have a weapon at the ready (i.e. quick access safe bedside, etc., locked-n-loaded), a flashlight, and phone nearby..
    - have a "safe room/area" you and family can go to and take defensive position if someone' trying to get inside
    - always have spare mag/mags, or weapons w/in reach..
    - always learn proper use of your weapon, before it's too late..
    - always practice safe storage (common sense, ...kids, ..etc.) and remember the 4-rules of gun safety.
    ;)
