Warranty Situation

    So here is the deal. Couple of weeks ago I decided to trade my Tacoma in for a Tundra. I found one at a Honda Dealership which was at a very good deal and so I decided to go with it 2009 v8 4.7 with 65k miles. When I test drove it, I loved it no issues and drove really well. Honda also offered me a 3rd party extended warranty that I bought from Olympic care. 2 days later, the truck decided to shake a little between gears, which comes and goes. So I called the manager at Honda and explained him what was going on. He told me to bring it in. Mind you this dealer is about 60 miles away from me. I drove all the way over there and their service tech drove it and no shake. HE made me feel pretty dumb asking me questions like “have you driven a Toyota before, have you driven a truck before, it’s normal for them to shake” I told them that the shake I was talking about was not a normal shake. Anyways it didn’t shake while he was driving it. They told me that since I purchased an extended warranty on the truck I shouldn’t be worried and if it keeps happening to call them and that they will take care of me. I waited about 3 weeks for the warranty to kick in and then finally called them. They told me that because it was recently purchased, I should take it to the dealer I bought it from. I told them that I didn’t trust the Honda dealer ship with my Toyota truck because all they did was drive it and told me nothing wrong with it. I would like to take it to Toyota instead. They authorized me to take it to Toyota. After Toyota checked the truck, they diagnosed that the water pump was bad and the front 2 wheel bearings were bad. Toyota also found out that this truck was taken to another Toyota dealership about a month ago for the shake that I complained about and they diagnosed a bad torque converter. They then had also put in their notes that the water pump and the bearings needed to be replaced. Because the previous owner did not have the truck under any warranty, he did not get the truck fixed and I’m thinking he traded it in for a Honda at the Honda dealer. I’m waiting on the warranty guys to call me back and tell me what they will do. But my Toyota service tech called me and told me that it seemed like they didn’t want to cover the cost because the truck had issues prior to the purchase. But he said that was just his assumption and I should wait to see what will happen. Now my question is
    1. Is the Honda Dealership liable for any of the issues if they sold me the truck on an as is condition?

    2. Can the extended warranty really refuse me service even though, I didn’t know what problems the truck already has? I’m only concerned about what’s going on now.


    3. Also, if that’s the case shouldn’t the truck be inspected by the extended warranty before it’s applied to a truck to find any major issues with the truck already?
    I’m not sure what I should be expecting here but I’m hoping out of thousands of active members here, I’m sure at least someone might have gone through this situation before.

    Find your third party warranty paperwork and start reading. Hopefully you end up alright at the end of this. You would think that the warranty people would have done their homework before taking on the warranty but who knows. They could also have some BS in their warranty coverage so go over it with a fine tooth comb. If the warranty company denies the claim, I'd be all over the Honda dealership to make things right.

    yes you are right i just read the entire contract and no where it says that they will not cover the cost if the vehicle had existing issues. Also it says that by signing the contract, it doesnt gurantee that i will have coverage. The Insurance company will either deny the application or reject it depending on the condition of the vehicle. (that clearly tells me that either honda lied to you that the vehicle is fine or you failed to check it yourself) either way i bought the warranty not wanting any issues and it should cover the issues im having. Otherwise why would people by 3rd party extended waranties not knowing what exisiting issues the vehicles might already have.

    If your warranty doesn't cover you, I'd start looking at lemon laws in your state. You said you bought it a couple weeks ago, you might have some recourse at the dealership. Make sure everything you do, every dealership that has looked at it documented the problem (having the Honda dealership saying there's nothing wrong would be a good one to have preceding the Toyota dealership pulling their file showing the wheel bearings, torque convertor and water pump). I would also be in contact with the Honda dealership since they're the ones who sold the warranty, they should stand behind the products they sell. They are the face to face salespeople for this 3rd party company so if they sold you a crappy warranty, it should be viewed as a reflection on them.

    I would imagine they would have to have a very generous lemon law for that to help.

    I am a customer who purchased a truck from you on Friday 24th of Aug and I wanted to express my experience to you. I was in the market for a Toyota Tundra and I saw one that you guys had on auto trader. I called and spoke to Cody asking him for more details on the truck. When on the phone with Cody, while he was looking into getting more details about the truck, he goes “yeah my buddy traded this truck in and its selling for a really good price and we won’t reduce the price on it” mind you that I did not ask to drop the price I didn’t even care at that point since I was calling to get more Pics on the truck, therefore, me asking to reduce the price would be pointless. I live in Richmond Texas and I drove all the way down there to see the truck. When I got there, Cody wasn’t there. A very nice and friendly young lady with a beautiful smile by the name of Priscilla greeted me and got Chris to help me out. Chris showed me the truck, I drove the truck but because I had to be somewhere, I left and told him that I would go back when I could. That same evening I went back and I was greeted by Wiem another really nice and friendly person there. I told her that I was there to see Cody since he was the one who initially helped me out. Cody was out on lunch with Gerald ( used car director) I waited for Cody about 15 minutes. He came back and I told him that I’ve driven the truck and I like it but I’d like to see what I will get for my truck first since I’m trading in. He asked me how much I paid for my truck and I told him $16500. While Gerald was looking at my truck, Cody had his back towards me, then he turns around and started talking down on my truck, making statements like my truck isn’t worth what I want for it, I over paid for it, and I shouldn’t be expecting too much out of it. I told him that I took out the value using NADA, KBB, and Black book and that’s what it was showing and his response was “ I don’t believe you, there is no way that Nada is giving you a value of $13500”, I thought this entire gesture was extremely rude especially when he wasn’t really unprofessional and not very friendly from the get go. He then comes with the final appraisal of my truck at $11000. I was expecting at least 13500 for it. He goes “told you”. I decided that I wasn’t going to go with the deal since that’s not worth it and I couldn’t stand Cody’s attitude anymore. He then asked me what will be the bottom line since there is no way I will get what I want so he can go talk to Gerald in spite of the fact that I had already told him what I expected. After talking to Gerald he tells me that the max they can offer me is $12k not a penny more than that. I once again told him that it’s not possible that you guys are giving me $12k for a truck that’s a TRD OR Tacoma and he goes “oh it’s not TRD OR since it has no decals on it”. I told him that there are no decals but that doesn’t mean that it’s not, learn about Toyotas and know what a TRD package has to offer it’s a $3k package at least give me $1500 more for it. He went to talk to Gerald and came back saying that we will still pay you $12k because having a TRD package doesn’t make a difference. It’s like telling me that the HONDA DX, LX, EX and Hybrid are ALL SAME VALUES ???? or if I stick the EX badge on the DX, I will get paid EX value? Anyways, I was so fed up and tired that I wanted to leave and I told him that there are issues with the tundra as well but I’m not complaining but I’m constantly being reminded about all the problems my truck has, he added “you liked the tundra the way it is or you would’ve never came here twice”. How condescending. I wanted to leave, I was done, I have never been treated like that before at a car dealership. Before I left, I wanted to let his boss know how upset I was with his attitude. Gerald came and spoke to me and the max he offered me for my truck was 12500 and told me that he couldn’t give me a better deal because they made a deal with their buddy whose tundra I was buying. So basically they gave him all the money they could so now I’m the escape goat and make money from me. How is it my fault that you hooked your buddy up and now I’m out of luck. Very disappointing.

    Because I really liked the truck that you guys were selling, I went ahead with the deal but I wasn’t happy with Cody and his attitude at all. It was already 6 pm and I had a long drive back home. I wasn’t very happy about you guys paying me only 12500 for my truck that I’m sure will be selling for more than 16k at the same dealership. Champion Toyota offered me $13500 for my truck but unfortunately, they didn’t have the truck I wanted. Saturday morning, the Tundra I bought from you guys, started shaking really bad right before shifting to third gear. It sometimes does it and sometimes it doesn’t. I drove it for a little bit so I thought it was the road. Sunday it did it a lot more. Monday first thing I spoke to Gerald and he said to bring it in. Mind you I did buy the warranty through Olympic but it will take it 3 weeks to kick in. I also talked to Toyota and they told me that it sounds like a transmission problem. I drove ALL the way over to your dealership on Monday to show it to them. Almost an hour drive one way. My bad luck that it didn’t shake all the time that your service tech drove it. They made it seem like that I was going crazy. He was asking me questions like “have you ever owned Toyotas before, do you know it’s a known issue in them, they are generally rough like that, it doesn’t look like its shaking to me” believe me I would’ve never driven that far waste so much gas just for me to make things up. Toyota across the street from my work, felt the shake. Comes out that after driving for a while, it doesn’t shake as much I guess me driving 60 miles there, delayed the shake. Long story short, it’s still shaking and jerking while changing gears, sometimes. I guess I’ll just wait for the warranty to kick in and then get Toyota to take care of the issue. I just wanted you to know that despite of the fact that I bought my truck there, it was not because of the staff it was mainly because I wanted that truck in that color and model. Even though the truck didn’t have original mats, radio antenna, damaged seat upholstery, damaged front bumper, 2 new off road tires, and 2 okay street tires, and it shakes ( positive it has transmission problem) i still paid the asking price for it, where I was short paid almost 2k for my trucks because it was in a bad shape.

    I have shopped at many many dealerships but I haven’t had an experience like this before.

    yeah thats like $1500 only. If i have to pay for all the repairs out my pocket im sure im looking at thousands.

    After reading your letter to the GM, I'm not sure you should have purchased the truck to begin with. There is a LOT of stuff going on with that truck and dealership that throws up red flags. Between him arguing about your truck, not giving you fair value, no negotiating and the damage to the Tundra, you might be SOL. The dealership sounds shady, so does Cody and this 'deal' he had with his friend. Whatever he paid for the Tundra to buy it off his friend is not your problem and you should have let him make it your concern. He should have never told you that and it should not have made any difference to you.

    It doesn't sound like the Tundra was very well cared for so I think it was very smart of you to buy the warranty. I'm not sure I would have gone near it...

    Hopefully, the dealership is actually a good one and your letter is news to him about the actions of his employee. I really hope you're taken care of!

    well all the issues i had was mostly service. My truck was in a bad condition and when i bought it, i bought it cheap myself. As far as the Tundra is concerend, it was a very very clean truck, the few problems i talked about were verr minor but i wanted the GM to know. Now i didnt think it was that big of a deal since i was getting a good deal on it and it seemed like it was well taken care of. i knew i was going to buy the waranty so i didnt care much about what was wrong with it. Also, it had 60 k miles on it. Had it made a single shake while i drove it, i wouldve definately not gone near it.

    ok so just got done talking to the warranty company. The adjuster said that he is talking to the Honda dealership to see what they can do about this. He said either way if they dont cover the cost or meet them half way, they will take care of it so i shouldnt be worried about it. However, he did mention that because the transmission issue was reported before the warranty, that they wont cover but he is trying for the Honda dealer to take ownership for it and help me out. Ill let you guys know what happens.
