    Bad judgment would have been kicking the rock. it didn't do anything, and it might hurt his foot.
    And as said until you are in THAT particular situation you really have no right to criticize from just watching a video of it.

    But I am done arguing, I have stated my opinion. And I am sticking to it.
    Cause we all know the one about arguing on the internet and the special Olympics...

    Everything said in this thread is an opinion, so I won't preface each sentence if my post with IMO... just imagine it's there...

    It doesn't matter if the guy hit a pedestrian or if he hit a tree or if he hit nothing... The cop's job is to arrest him and make him pay for his crime, NOT to try to exact whatever punishment the cop deems necessary. If he wants that responsibility, he should be a judge.

    That scum-bucket should go to jail for a long time. I don't condone anything he did before or during the chase, but in the end he gave himself up. I would have no problems if he was injured because he was fighting back, or if he got shot b/c he pulled out a weapon. He was lying on the ground, face down, surrendering to the authorities (albeit later than he should have).

    I don't buy the argument about adrenaline pumping and me not knowing what he was going through. Learn to control yourself and your actions. Be above the petty behavior that the criminals themselves exhibit. When I was a kid, my parents told me to trust and look-up to policemen. This cop should have kept that in mind as he was chasing that guy.

    Obviously, what this criminal did was excessive... but what happens if you blow through a stop light and the cop that pulls you over sucker-punches you in the face b/c he thought you were driving dangerously? What happens if he kicks your Tacoma and leaves a nice dent? When we're OK with cops taking a little of their own revenge in addition to performing their duties as officers, where do we draw the line?

    the officer who booted him is saying that he was screaming at the gangbanger not to look at him... reason being that procedure is to have the surrendering suspect not have the officer in his line of sight so that he can't track him to quickly pull out a firearm. If they aren't looking at them then when they pull it they still have to locate the target.

    Ahh... it becomes a little clearer... I still don't know if the kick was necessary, but at least I know a reason now.

    That wasn't even that hard of a kick. No windup or nothing. He just wanted the dude to turn his face. He wasn't so he gently tapped him so that he would turn his face.

    Incorrect. The phrase "To serve and protect" has been removed from most police cars/shields/etc. The case Castle Rock v. Gonzales set the precedent that more or less states that police are armed historians. They are not bound to do anything to "protect and serve"

    I've been thru the training and several real life scenarios- Never had to kick anyone or use any technique outside of policy to maintain control of a situation. I have dealt with the scum of the earth- and it's not personal. As soon as it is....Something like this happens.

    I totally believe he was telling the subject to look away...but he was in the wrong spot (imho) and he was not in danger cause the banger was looking at him...He already have his weapon out and any movement by the subject would have been responded to. The subject didn't do anything and the kick does not align with any use of force procedures I've ever been exposed to in the US.

    He could have waited for back up and been fine....Kicking in the head I will almost GUARANTEE is not within policy.

    I agree... If the guy had made a sudden move for a weapon, the cop (and the other cops around) already had their weapons pointed at the guy's head. I don't know anything about police procedures (and clearly you do), but I can't imagine that the kick to the face was part of an acceptable course of action.

    he resisted the SECOND he refused to pull over
    he was resisting during handcuffing...notice how long it takes to get his arms behind him? while not FIGHTING...it appears as though he was passively resisting

    no its not...but brunes has already covered that...

    this is a good post ^^



    i'll reiterate that i wouldnt do it...BUT i know several people here and there...in different depts that have been suspended, fired, or charged for actions taken similar to this

    i also know of several cases here where the perp claims excessive force, its on video...and the LEO gets off...one of the more recent ones being a SCHP patrolman was in pursuit of a guy...guy bush bonds...runs across the highway...and the officer hits him with his car...he's caught on his own tape saying that he meant to hit him...

    he's absolved of any wrongdoing (IIRC the guy running had already tried to hit the officer)

    point being...a lot of these guys are good guys...and good cops...and sometimes...eventually...the stress can get to you...most of the situations i know about involves ranking officers...ones that do KNOW better...and yes i realize officers are held to a higher standard...but at the same time...you have to realize...we are humans too...we make mistakes...we have emotions...we have stress...sometimes someone mismanages this and it boils over...then you end up with something like this

    WHAT IF he did run some one over during that chase and it was Osama Bin Laden or some other Al Qaeda terrorist? Then you guys who are all about "this dude is a douche who deserves to be kicked in the head" would be running out to CA to shake his hand.

    "What if" is a fun game to play, but the justice system is based on What Did happen (thank goodness). And he did not seriously injure anyone during the chase (thank goodness again). But there is proof "without a reasonable doubt," that the cop went a little too far "above the call of duty."
