Jim Carrey's "Cold Dead Hands"

Seeing as the AWB was dropped and I'd be really surprised to see that pass I won't address the "If its the kind of gun they say I can have part." Personally I think people are interpreting it differently. You can sit there and say its clear all you want but to me it's more of an interpretation than some clear cut distortion the way you see it. The right to bear arms shall not be infringed. You interpret that as I should be able to buy any gun without any process or procedure. To me infringing upon that right will have meant you were prevented from obtaining said gun. I don't view a background check, or registering, or whatever as preventing you from owning a gun. You were not kept from getting it.

Under your interpretation (correct me if I'm wrong) any gun should be legal and no questions asked upon purchase. So you could walk into a gun shop and purchase a fully automatic weapon, hand the person cash, and then walk out. No questions or no background check or any record of any nature. Correct? So in theory a convicted felon could walk into said store, hand the person cash, and then walk out, proceed next door where he robs he neighboring store and shoots the owner. Now I would hope the one thing we could agree on is that a convicted felon shouldn't have legal access to a firearm. However in this scenario with no checks there was no way to know this person was in fact a felon. This is the part that baffles me with the whole background checks keep law abiding citizens from getting guns argument. You're a law abiding citizen and that's all well and good but how does the gun shop owner know that when you walk in the door?

We'll just have to agree to disagree on this because I don't see how something is infringing on this right if it didn't actually prevent you from getting the gun. The banning of new guns is something I could see someone making more of an intelligent argument against however the most basic aspects such as background checks and the like just don't strike me as infringing on any rights. But I guess I'm wrong and just have a distorted view.

 

You are correct, that is how I understand "shall not be infrenged". However, I do not believe we should allow certain convicted felons and certain of those with psychological problems to own or have direct access to guns. Our founding fathers were also clear that the intent of the Constitution and B of Rs was to limit governments control not leave it open. My point is, there is a provision and method detailed for revision and if the population wants it revised then follow the proceedures.

That being said, I would never vote for anyone trying to restrict (in any way that I can think of) ownership of guns to citizens not falling into the catagories above.
