    You only get the lemon law if they fail to fix a problem 4 times, not 4 different problems. A blown motor is rarely a lemon law issue as it can easily be blamed on misuse by the owner. Get your warranty motor but forget the lemon law, you probably do not qualify. Every state has its own lemon law and in Florida there is no provision for the vehicle being out of service for more than 15 days so the month you say they had it will not be an issue.

    That basically says that if Toyota doesn't fix the problem and refuses to do so, then you can file a claim (arbitration) and an independent party will come in and decide if toyota is liable to correct the problem or not.

    That's what I was thinking. He had the work done outside of the warranty period. So he won't be able to go with the lemon law (?)

    Lemon laws cover new vehicles.
    There is generally no protection on used vehicles or vehicles that are out of warranty.

    Lemon laws vary by state, but most generally follow the guidelines that a vehicle is considered a "lemon" if it has been in for service for THE SAME PROBLEM more than three times in a 90 day period.


    My buddy went through this with his Cherokee. It was a year-long ordeal, and was barely able to get the arbitrator to sign off within the warranty period. Another month and he would have been SOL.



    Out of warranty? Seriously? Does anyone really expect that I could have applied the lemon law to my POS '95 Suburban that cost me $3000 in the year that I owned it?

    Some people might say they tow more than 3 tons and even the mfg. may rate their vehicles to tow that number, but seriously if I'm buying a used truck and I have a choice I would choose the one that have not towed a 6000 pound trailer. Buy a V8 if you want to do that. Sorry.

    In CT it's the same problem 3 times or three seperate problems but major repairs.... I had my flywheel replaced twice under warranty. At 90k it's starting to chirp again..they probably won't fix it. And lemon law would require me obtaining an attorney and if i win, then they would pay his fees. If not, i'm on the hook for it...For me, I am gonna fix it myself with some type of after market upgrade...

    hey thanks for the info ill have to go pull that out and check it out

    its all under the drive train witch it 5yrs or 60k

    yea well the truck is rated at 6500 so i should be able to tow 6k no problem and its not like v8's are much better tacoma has all dana gear if i wanted to tow alot i would buy another diesel. and trucks are always rated under what they can really pull especially if you upgrade your leafs and shocks.

    I know a little about the lemon law, did it to my 08 z71, first step is to file a claim with corporate, then call the BBB and they will mail you a packet to fill out

    and thats what i mean having your tranny go out and the engine twice to where the truck isnt drivable at 31k miles is just plain stupid should never happen.
