    Next question~ What about the value of my truck that was totaled? It was a 2013 with 944 miles on it. I had it for 17 days. Is there some formula they use to calculate the depreciation? Kelley BB doesn't even have values on them yet.

    Do I have to take what I get or can I ask for more? Do they go off sticker price, what I paid for it, or some other secret insurance value list?

    You weren't going to see the medical expense money anyway so that's irreverent. His insurance will pay for pain and suffering with broken ribs. My buddy got between $5k and $10k pain and suffering for 1 broken rib with a collapsed lung in an accident that wasn't his fault. He spent a couple nights in the hospital though also.

    I would suggest talking to a lawyer. It won't cost you anything and will most likely get you much more than you'll be offered without one.

    The other insurance company will make you an offer for the replacement cost of the vehicle. You DO NOT have to accept what they give you unless you feel that is a fair settlement.

    If they do not offer enough to cover a new vehicle (price of vehicle + tax, title, and license), your argument is such: they are responsible as an insurance company to make you "whole" again. Basically you should have no out of pocket expense in order to have what you had before.

    With regards to personal injury, they are liable to cover any and all losses that affect you from the accident. There is absolutely no time frame on this. For example, a year from now, if your ribs were still bothering you, they would still need to take care of it. I hope this information helps you.

    Get a lawyer!! I had three broken ribs in 1988 and they still hurt, this injury will bother you for a long time, be sure the lawyer knows everything about your hospital visits. The lawyer will know exactly what to do and have answers for all your questions.

    Glad you're okay. When I was changing my fenders out, I had a hell of a time getting those things off. Looks like you found the faster way...

    Just kidding, glad 2 ribs is the total extent. Sounds like it could have been worse.

    Man, was it in Killeen? They never pay attention to anything there.The few times I have been thru, it seemed like I almost got hit every time. Glad to see you made it out OK though. I'm with everyone else, get a lawyer if they don't offer you enough to completely replace your truck, and all the mods you could want. If you did nothing wrong, you get paaaiiid. That is the reason that the other driver mails off that insurance payment every single month.

    I was in the same boat as you about a yr ago, but my bro was the driver not me. He ended up totally my 08 Titan that I bought 6 months before. I thought I was screwed, since I paid off the truck the day I bought it. I have never been in an accident, neither has my bro in our 15+ yrs of driving, so we hadn't a clue how insurance was going to handle it.

    My sis-in-law stepped in (has had an accident every other yr, haha). She ended up doing everything and 2 weeks later I got a check for $6k more than what I bought my truck for. I was super ecstatic and glad everyone was ok AND I got rid of that 12mpg truck. I loved the power and tq but not the mpg's. Had to wait a few months to get into a 12 but it was all worth it in the end.

    Thanks for all the tips/advice and well wishes. I'm definitely going to put it to good use when dealing with the insurance companies here in the next few days.

    @JayS, it happened on Fort Hood, but yeah I totally agree with you about the terrible drivers in this Killeen area. I think it has to do with such a high concentration of young, inexperienced, male drivers, from all over the country, who may be driving their first car.

    I've already called my salesman and he's working up another truck, just like the one I lost. This time, I may not have to save up for the goodies to go on it. Im thinking steel plate bumpers and rock rail side protection should be going on immediately lol

    Would like to get an update on your story, and what happened with the insurance? I paid cash for my 2013 Double Cab Taco, would hate to loss it that way too.
