    I have been on workers comp since November 6 2012, and was just released to work today and when I get there I find out I was terminated 3 weeks ago. can I sue the company that terminated me for terminating me while on workers comp?

    Not a lawyer, but something similar happened to my dad 3 years ago.

    He took a month vacation he'd been saving up for, and on the 3rd week, he called in to ask about something and they informed him that he'd been laid off a week prior. We didn't take any legal action.

    its a local a/c and electrical contractor, and I went in to say I was released to regular duty at work and was told today I was terminated 3 weeks ago with no notice to me what so ever.

    A quick google search found that Florida, like many states protects someone for being fired for filing a workman's comp case. Now, you have to be sure that you did all the steps during the comp time to prevent them from finding an excuse.

    In AZ a friend of mine went on and off workman's comp for a otj back injury. They could not fire him for any reason during that time. However, they wasted no time looking for a valid reason to fire him after he returned to work.

    If I were you, I would call a local lawyer and get a free consult.
