    You must be a young rider, but looking at the rear mirror is just important as looking forward, and sometimes you can see them coming and get out of the way.

    If you have a different insurance company than hers your insurance co. will go after them so they have no cost against them.If you happen to have same company you are gonna have fun fighting with them.I had a drunk driver hit a vehicle I had with about 4,000 miles on it bent the frame messed it up good insurance said they would fix it.I told them I didn't want it since it was hit in the front.I was mad the guy at repair shop said it was totaled,insurance said no.They put it on the rack to try to straighten the frame,transmission fell onto the rack insurance guy said I guess it's totaled then.Good Luck!!

    Your options are few. Eat the dog shit sandwich her insurer is offering, or lawyer up and be prepared to spend a lot of money. Your own insurance is damn well not going to total it out and why should they? They aren't responsible for Little Miss Texting Fool's actions.

    You're probably going to have to go to war with her insurance company. They have a lot of money and very experienced lawyers. You may spend thousands and not win. Those are the breaks, but that's how the game is played nowadays.

    I just went through this with my wife's car. I lost, BTW.

    I'd like to see some pictures also, I'm just that way.

    The frame is bent the bed is destroyed the cab is damaged and racked it looks like a total loss regardless I am not bringing the truck home the truck was new the first time I drove this got creamed it looks like they are going to total it if not they can sell it.

    What does it mean " racked ". I am not familiar with that term with respect to a vehicles damage.

    Where are the Pics OP?

    What skiwaves8 said. Deal with your company and have them fight for you, thats what you pay for. Think of it this way the other company is going to do everything thing they can to save money.

    I was rear ended two years ago a co-worker two weeks before. I contacted my company he decided to go with the person who hit hims company. My truck an 06 was fixed with OE parts and back to me in 8 days. His was fixed with used and aftermarket parts and returned to him 8 weeks later, he's still dealing with it.
