I think you're playing it safer than I would. If I had a clear title and could prove it was my land, I'd call up a couple friends, buy some feed corn and herd those cattle to his land right quick. Get it done before the cops arrive and then let them tell HIM it's a civil matter. You can prove it's your land with title in hand. What's his complaint going to be? He can't provide a contract or lease agreement, he has 2 cattle on his land now and there are none on yours. It's his problem he can't keep them on his acre plot, not yours. To be completely honest, it sound like you know what needs to be done, but don't want to risk having to explain anything to the Sheriff. Living in MO and growing up in a farming community, cattle and land disputes are pretty normal to me. I never would have talked to the Sheriff in the first place - those cows just would have showed up on his plot, a strand of electric fence would have appeared and it would have all been done before he knew what hit him.

Im lost in this, if i try to comprehend it i get a headache. Its o.p.'s Land, o.p. has proof it is his land. There is no contract for neighbor to use it. Seems simple to a city idiot like myself.

OP, your neighbor has too many cows for his own land. He has this problem because of the verbal agreement. He can't just move them to his land. He will need to get rid of some first. If it were me, I would discuss with the guy a reasonable amount of time to downsize and move the cows. Then I would have my lawyer draft that date into the appropriate documents. Then hope he complies.
Sucks, but that"s how I would handle it.

UPDATE - Yesterday afternoon he removed the cows

He loaded them into some 3rd world crazy looking ramshackle trailer. The Trailer looked like it was sections of chain link fence tied together with rope, and drove off. Took all day for him remove 2 cows, as he apparently needed a welder to make repairs to the trailer and hitch after he got the cows loaded and tried to drive off. But, they are gone.

So now I got to do some cleanup, replace some of the fence posts, remove some old useless fences that block of part of the pond (the cows just went around or through these and I don't want them), and the feeding/shelter stall he had for the cows.

Going to stock the pond with florida bass, blue gill, and such.

 

Glad it finally worked out, hopefully your neighbor stays out of the picture from here on out.

 

Think I just saw that exact same dude at a gas station....I asked him where he's taking the cows.....said somethin' about tradin' em in on a bunch of goats.......
