Lemon law, arbitration or both for my Tacoma?

    I won't bore you with details as over 2000 people have been following my story.

    I filed a lemon law case yesterday, Toyota called me today to confirm and also told me that I can use lemon law, arbitration, or both. Anyone have any idea which way is best now that I have already filed lemon?

    The only thing that I see so far is that arbitration is supposed to resolve in 45 days, lemon may take longer.

    My thoughts are only way you may be happy at this point is just file lemon and get out of it. However I know there is a cost factor if you can absorb will make you much happier getting rid of truck. Just bought a 14 and had I seen this and others with same issues may have thought twice about Toyota purchase. Good Luck !

    Know this... when you file Lemon on Toyota, if they even have an inkling that they can win, you will be in court for a long time. If they know they're screwed, it will be resolved quickly.

    2014TRD....Absolutely, I have purchased 3 vehicles from Massie over a 7 year span, they are a great dealership, service is even better.

    Randy was my salesman twice, and Gary always takes good care of me in service. If anything has made this situation bearable, it has been Gary and Terry, one of their Mechanics.

    Lemon Law - Case is resolved in court. Both parties must accept the end result. Can take months to resolve. Case is a legal one, and without a lawyer on your side, you have a higher risk of losing. Your cost- Cost of Attorney, legal filing fees, lost time from work.
    Expected possible results - You win, Toyota has to buy back vehicle. You loose, you get nothing, and may result in that part of your truck being denied further warranty repairs. (i.e. transmission issue may result in transmission warranty now defunct, remaining warranty still good)

    Arbitration - Both parties cases are heard by a third, neutral party. By signing on the dotted line when going through arbitration both parties agree to accept the arbitrator's decision. Arbitrator should be selected independently, and NOT by Toyota or you. Both parties have to accept the arbitrator. Your cost - Time from work to arbitrate. May take multiple visits.
    Expected possible results - Win or lose, the arbitrator will decide who gets what. You may get all your money back, or you may have to settle for partial reimbursement for troubles, and the same situation for warranty. (example: You keep truck, Toyota gives you $xxxx.xx amount of money as a "partial refund", and you agree that the case is settled and will not file further legal action)
