    I think the issue is that the property that is assumed by the surviving family is being taken by the govt. under the presumption that said guns are just being sold at a garage sale for $.50. I really doubt that is the case and I'd expect some serious backlash as far as property rights are concerned. The pistol permit might throw a loophole in there though, I'm not sure what the deal is with that.

    My issue is that the "government" thinks they have the right to property of someone who dies. This case is about guns...I was given guns by my father who recently passed that were owned by his father. I have an issue with a group of people deciding they have a right to take such and any property of a deseased person.

    I'm guessing it has more to do with unregistered firearms being passed onto generations or other family members who don't use them and keep them in a shoebox in the closet, instead of having them registered under their name (or not) and kept in appropriate manners as to be difficult for a casual thief to find them, sell them on the street and/or use them in a violent crime.

    I think the death rate is going to vastly surpass their ability to track with any accuracy the passing down of guns. And if sais guns are then registered in the new owners name (if that what is required by law in NY) then it becomes moot anyway. I feel like someone thinks the major supply of guns is coming from these estates and is trying to stop that but I think it's misguided at the very least. As I said before I think it may raise a question about violation of the 4th amendment, I ignorantly can't say I have heard of the govt. just taking property due to someone dying and to do so would be an "unreasonable seizure" however you spin it.
