    Hopefully someone who works at or owns an FFL can chime in, or maybe someone with legal experience?

    Recently a friend of mine had a mental breakdown and is in jail (psychiatric wing) with a few felony charges, thankfully none involve assault or weapons. His mom has since gotten power of attorney signed by him and notarized, and she's needing to sell his 3 firearms.

    Can she complete a private party transfer at an FFL with her power of attorney, or does he still need to be present for the paperwork? This is in California.

    Thanks bro. He's a mellow dude, known him for 10 years, never had a single problem with anything. Snapped all of a sudden randomly (no known triggers), not sure if it's a medication reaction to anti-depressants he was recently prescribed or if he has undiagnosed mental disorders, but he's definitely a decent dude. Really a shitty situation, nobody hurt, just broke all the windows out of a car and ripped off a security door, the felonies are from (I believe) the property damage, resisting arrest, under influence of drugs.

    Only thing I've ever known him to partake in is marijuana. Anyway.. none of it makes sense. Thanks for the kind words.

    No problem man thats what we are here for , support . Just be there for him and give him allot of support , I lost a good friend from drugs . He was the same good guy , he just snapped after his dad died and he got hooked on drugs .

    Hey. Sorry to hear about your friend. I don't have a lot of exp with this but I had a friend who was having trouble after we got back from a deployment. His mom somehow got control of his firearms and sold them off. I'm not sure what exactly she had to do though. With a full power of attorney I would imagine that she can do anything with his name on it.

    Thanks guys. I'm hoping it wasn't a more hardcore drug than the weed that it's always been, there was talk of it during the arrest as he was very violent (to himself and to property) and was very strong, like a person with a mega adrenalin surge like you'd get some meth and similar drugs. But he wasn't given a drug test and he wasn't a scumbag to my knowledge, so either he's hid it incredibly well or it's not a drug situation that caused his rage that night. He lives with his parents still and shares a room with his brother for the past month, works full time and either is home or is at work, so not much privacy. Who knows though, he'll be in court tomorrow at 8:30AM (last week he was deemed mentally unfit for his trial and it was postponed until he was seen by a doctor, etc,.) so I'll have a better idea then, hopefully.

    Very sad for him. Really appreciate the support. In the last 2 weeks, me and my fiance have progressed into closing on our first home, we've confirmed we're pregnant (7 weeks along), I've lost my great uncle, my last remaining uncle who's had a liver transplant to get rid of 1 cancer now has developed 5 separate cancers and lost most brain function due to lesions on the brain, had to put down my sister in law's horse, and my buddy referenced in this thread went crazy less than 24 hours after I saw him last for several hours, and seemed perfectly normal.

    Seth, thanks for the info. I thought that was the case but never been in this situation before and his mom is not remotely familiar with anything firearms.

    I feel your pain PeeRunner as I have gone through very similar with family members. I really hope, after the situation is fully sorted out by medical professionals, there is the possibility some of those charges get dropped, at least the resisting. And maybe even the property if some sort of settlement agreement can be worked out of court.

    Thanks oldstick! I'm not sure how things work here in CA, but I'm hoping that if it's indeed a result of a medication reaction or mental disorder that the felonies don't stick and that he is able to get whatever treatment needed (if it's a disorder of some type). He's 29 years old, and I've never seen him angry let alone physically violent and full of rage. It's got to be SOMETHING.

    I don't expect it to be, but I hope it isn't drugs as that's another world of problems to be dealt with in addition to having little chance of his felony charges being knocked down to misdemeanors or dropped altogether. I don't think that's the likeliest reason for this situation. I do hope though that he's not slapped with a life sentence of a mental disorder, or having felonies on your record that you'll carry for the rest of your life.

    Never had any legal issues with any friends so far in my life and none in my family, either, so new territory for me and his family also. I wasn't able to make it to his court appearance today and haven't heard yet from his mom who did attend, but crossing my fingers it brings good news and not more bad news.

    Yesterday when we talked, she said he is starting to normalize mentally somewhat and he had memory enough to tell her where he kept his few firearms, and that he broke down crying and said he hoped they (his parents) were okay and not being harassed. He also asked if it was okay to drink the water and eat the food they're giving him at jail, and that he still isn't sure what happened and doesn't really know he's in jail, or that was her feeling at least. This is a huge improvement over last week, in reference to his mental capacity. Last week he was given a postponement on his court hearing because his capacity was questionable, so this is a good step forward in a promising direction. Hopefully it's the medication he was taking, and I'll have my good friend back to normal and back to being himself soon.

    Sounds hopeful then and even more in his favor that he doesn't have any kind of prior records. From what little I have learned, it is a very common pattern for mental imbalances to stay dormant until early adulthood, teens or twenties. And very common for drug use to help bring it to the surface.

    And that is all these conditions are in most cases, a medical/chemical imbalance, which can be easily treated for a normal life, with some cooperation from the patient.

    Cooperation is key. Just hope it doesn't come to that point, or if it does, that he's able to be functional and have a good life. Thanks bro.
