A moveable aerodynamic device has been illegal all season , the FIA has stated that the way teams are utilizing FRIC has made it more about presenting the aero package of the car than a suspension component and stated that any protest from other teams as such may result in a disqualification so all teams have decided to not run the system and apparently the Lotus system was the most advanced

but the rule isn't changing , the FIA just stated that if teams protest another team's use of FRIC , they would be inclined to rule that it's currently being utilized as a moveable aerodynamic device and would therefore have to be deemed illegal

The teams could have unaminously agree to keep FRIC legal as is , and the FIA would not rule against it , but they failed to agree on it

 

I'm not trying to argue , just stating that the FIA views that the implimentation of FRIC has evolved from a legal suspension device into an illegal moveable aerodynamic device , therefore if there was any protest by one of the teams against another team , with the way that FRIC is being used by the teams currently , the FIA would have no choice to rule it illegal

The unanimous agreement amongst the teams regarding rule interpretations like this is a mechanism of the Concorde Agreement that all teams signed with F1 that governs how these types of issues are resolved

 

I'm willing to bet somebody complained , and with Lotus apparently having the best system , and McLaren fighting them for Constructor's points , and the fact that Boullier just moved , unamicably , from Lotus chief , to McLaren chief , I'll wager it was him
