    It was s possible that Moondog may set a precedent that forces Toyota's hand. While I do agree with a lot of your logic, CookieMonster, and clearly you are a good troubleshooter, I am seeing Moondog as one of the fighters for our cause. He just takes a different approach. I think he will win. We need to cheer him on.

    he will have to take it to the next level of analyzing the problem by experts other than Toyota, if they find a problem then you got a leg to stand on, up till now its a mute point to argue with the Dealer or Toyota corp they have made up their minds about it quite along time ago

    Mine has 4500 on it and started Howling at 300, thankfully it has not gotten any louder but the mph range has widened

    Likely, though lawyers can be pretty persuasive. My thoughts: Toyota will see the threat and fix him up quickly and quietly.

    I am starting to notice a slight hum when feathering the throttle.

    It is not that big of a deal. I am not sure I would have issued a complaint or even thought it was anything other drive train noise unless I read this forum.

    Mine got louder but has now tapered off and I have also noticed a wider range now. If it did it at 90 I doubt anyone here would have a serious issue with it but geez, it's doing it at the speeds I drive the most on some of the roads where I live and hunt.

    By saying it's a normal sound for this truck, Toyota is basically saying they designed it that way. Even if it's normal, I would like for them to say exactly what is making this normal noise.

    Some of them do it and others do not, they have been very inconsistent with the issue.

    This question is for the attorneys involved with this thread.

    If someone repeatedly tried to have the issue repaired by Toyota with negative results, then had it successfully repaired at an independent shop, would they have legal recourse against Toyota to recover the repair costs?

    They will keep us in the dark. That is what they do. Not them, alone, but most large companies. Admitting guilt opens the doors to losing a lot of money.

    Did you document each visit with them?
    Some laws make the distinction between "attempt at repair" or "subject to repair"; the latter meaning, how many times you presented the problem; no matter the diagnosis or lack thereof. It protects the consumer against the "normal" bullshit.

    In theory, you could but the LL is the usual course for warranty issues that the manufacturer cannot or will not fix. The issue is whether or not it is worth it. You would need to find a lawyer in your state that is willing to take the case and is willing to fight it. Also, if you are willing to go that route you could just as easily LL this truck. Remember, to qualify as a failed repair, you just have to take the vehicle in with a defect and leave with it not fixed. Many car dealers try to be coy and say "it's you again, we can't help" and they don't write it up. Keep a log, take a selfie (not kidding) with the service rep whether he likes it or not, or best case get them to document you were there for rear diff howling. Finally, a "fix" does not have to be available. GM tried that with me was no dice. All I cared about was that my SUV did not get fixed and they couldn't fix it.

    I know Jalopnik may not seem like the best source to cite but the article from Mr. Lehto (which I have posted before) regarding failed repair attempts is spot on. I do not agree with him insofar as his stance of it being a waste of time dealing with corporate. He's a plaintiff's attorney and gets paid for suing people. I have had great success with GM and FCA going the 800 number route. I am not as warm and fuzzy feeling over Toyota corporate. This is no slight on Toyota but their corporate staff doesn't budge quite as much as others or they are in a mandatory state of denial...

    BTW, this is just friendly back and forth, no legal advice, just helping some friends.... ;)

    So when everyone says a "take it to an Indy shop /differential specialist"...what should I be googling / asking around for? Is it just AAMCO?

    I'm trying to unload my truck, but the best I have gotten on trade is at roughly $3k -4k under market. So in effect I am going to lose $3k-4k trying to trade this in. I'm really not super thrilled about any replacement options yet either. Private sale is the next logical option but if anyone hears the howl, which they will, they'll be like "wtf are you trying to pull". I feel bad trying to unload this as a private party.

    Since the howl is the main reason I am considering unloading the truck, having an Indy shop diagnose it might be worth a try.
