    There seems to be quite a few individuals in this thread that had seem to have no clue you can be cited for causing a wreck. The rules for maintaining safe following distance in any conditions are a part of most if not every states driver training programs.

    To think you shouldn't get a ticket because your vehicle was damaged would be like running over someones mailbox and thinking they should call it even since you got a dent in your bumper.

    Not really, cops around here right it up as no fault. Guess that way it keeps them from going to court or any other legal matters.

    Ahemm..... innocent until proven guilty doesn't cost more.. that would be UN-constitutional my friend.

    On the ticket you either choose innocent or guilty.. sign and send in the ticket with fine... pretty 100% positive its the same price either way you choose! Just sayin....

    If the police officer feels you are breaking the law and that was the cause of the fender bender, then if they are doing their job, they should give you a ticket. Does it suck, yep.
    I tell my kids, you may not have intended to damage something, but if you put yourself in the position to have the accident, is it really an accident? could you really prevented it?

    Fixed that for you.

    The reality is that just paying the ticket costs $X. Going to court to fight the ticket and losing costs $X plus time off from work plus court costs. Might even cost more if you piss off the judge with an idiotic excuse.

    Exactly why I never liked the term "accident". I much prefer "crash". Of course, few people ever intend to crash their car, but many people do crash their cars because they were doing something stupid like texting on their phone instead of driving.

    No court costs for going to court .... you already paid taxes to pay the police and the judge... for tickets you pay the same court cost that is included in the ticket when PROVEN guilty. If you're innocent you get all your money back.

    Pleading innocent just means the officer needs to PROVE you were breaking the law. His word your word ... then the judge does his thing.

    MOST times we talk it over with the officer before the hearing.... plead out to a lessor offense - hopefully a Non-driving offense so insurance is not affected and fine is still paid. That's the "grease" that turns the wheels of justice.

    Giving out tickets for an accident is just mean and wrong.... unless of course it's warranted. Example... back into someone at the mall.... not even on public roads how can you give someone a ticket for that?? Just sayin....

    Is there a moving violation in this situation? Oh and I have been stopped for blowing a stop sign in a Wal Mart parking lot (after hours) before.

    Cops pulling you over in a private parking lot.. they can give you a ticket but in court tell judge I was on private property.. case dismissed (gavel drops)... next.

    If you're ever in this situation, you might want to do some research before you waste your time going to court to fight it.

    Oh, so using the private property defense. I got summoned to court because we were lighting off fireworks on my property. I was found guilty and fined.

    Court costs you pay IF you're GUILTY.... no way they can charge you for innocence... this isn't Nazi Germany even tho is sorta seems like it we still have some sort of freedom.

    So what you showed me was court costs IN ADDITION you have to pay IF you are found guilty as apposed to PLEADING guilty (you pay less)?

    Maybe that is Nazi shit right there.

    All that due to an "accident"?.... wow.

    Tell that to folks paying legal fees to defend themselves.

    Anyway you've gone pretty far off into the weeds.

    The original point was that the OP would have a heck of a time avoiding a guilty verdict on a following too closely citation for this crash. Best hope would be to plead a non-moving violation to avoid points, but insurance is already involved so that part isn't going to make much difference.

    I can't stand people who follow close, and it happens all the time here even on rural roads. I'll never understand it. If I see a deer or something, there's no way they're going to have the reaction time to stop before they go right under my hitch. I keep excessive distance behind people on roads like that, especially at night, because headlights behind me annoy me and I expect it's the same for other people.

    That said, in OP's defense, cities are terrible for it. I've driven on busier highways where I keep what I consider a reasonable distance in front of me and someone cuts in. Slow down and create space again and someone else cuts in. It's infuriating and it ends up being an endless cycle.
