You cannot make them total it.
However, there is a way around it.
Several years ago my wife was in a wreck. Not her fault but the vehicle was torn all to hell but not totalled. So, I did this:
Took pics and went to dealer. Told him I wanted to trade that thing for a new one. He also gets insurance check to fix.
He took my deal. I basically got a new vehicle and he got my wrecked vehicle plus check. He fixed it in his shop and sold it as used.

So, there is a way but be careful! You really need to fully work out the deal beforehand and understand it completely.
    Good luck.

I really hope so. I love my truck but I don’t want it back.

Hopefully it’s totaled and you can move on. In June I had to have a right, rear quarter panel replaced on my frontier after some damage. While the body shop did a good job, it wasn’t the same. When I got in the bed and leaned towards the right of the bed it creaked so bad. Go get you a 23 while you can and have the peace of mind that’s it’s new.

that’s exactly what I’m afraid of. Getting it back and having issues arise that weren’t found.

    Consider yourself lucky then.
Another factor is- what the adjuster writes the first check (or estimate) for versus what they truly believe it’ll cost to fix. Almost never do they write the whole amount, far from it, just enough to start work, then more funds as bodyshop requests.

Absolutely, and I don’t blame you. Start shopping for a 23 now man and don’t look back. I’d be shocked if it wasn’t totaled.

Also, you do not have to accept the first offer from insurance. It is negotiable. If they say otherwise you can remind them that having a court decide that will cost them additional funds.

Good question, was the unlicensed 16 year old the daughter of the owner of the car?

If she is you may have to get a lawyer to convince them to bring charges against their daughter for car theft or if they don’t then you should be able to sue them for willingly letting their unlicensed daughter have the use of their car.

I know fair and the law are two different things, but you are not at fault, you have insurance, and hopefully the owner of the other car has insurance. You are entitled to a rental of comparable worth. Normally your insurance company will make the other insurance company pay everything without involving you
