Advice on unhinged pool maintenance guy

Sorry- that was confusing. I am trying to find the actual owner. We have the pool guys name. We thought he was the owner. The pool guy told us the owner is going to be in touch- so there are two different people- one we did not know about until the other day.

I needed the DBA to try and find who the other person is.

 

I tried this already. Nothing comes up.

 

I vote that you paid the final invoice - now, stop over thinking it!

If homeboy cannot send out timely invoices, I doubt he has the paperwork skills to file a lien, nor do I think it would be worth his time/money to do so.

It is not like there was even an original [actual] signed agreement he can hold you to/demand payment for.
I think he was just talking smack to scare you.

Call his bluff - let it go.
IF you get something in the mail about it, then you can deal with it.
Don't make something a problem when you don't actually have one.

 

So the pool guy is using DBA because he is the owner. Because he didn't want to change the company name.
I know a HVAC co. That uses this. New owner is using old co name.

 

There are two people. One we know about (the pool guy) and another we didn't know about (not the pool guy), and apparently the owner. We never knew the pool guy was not the owner the company.

The pool guy told us "the owner" will be in touch with you. And has not been. I want to talk to "the owner" first and get things settled before it's escalated further.

 

In order to file a lien, the company would first have to provide formal notice per the following:

I would follow the advice of a termination letter sent if at all possible to a real address sent certified so you have a record. In it document the payment you made on the final invoice.

Otherwise, wait until something new happens in terms of lien notice or you see the check clear. And relax. The odds of a lien being filed seem very low given the circumstances.

 

You do not have a problem.

If/when you get a letter in the mail saying you owe X or we gonna do shit - only then do you have a problem.

 

Re the relax part. The other notable thing here is the wife is pregnant- so she didn't take the pool guy telling her this crap very well.

 

I would think that is more of a reason to let this one go [unless a letter shows up]

Thats why i said pool guy is full of it....and he may be the owner to.All this over 650?...attorney fees would be way more than it was worth

 

Look up the company name on the Contractors State License Board website. That will have an address. If he's not licensed cancel that check and give the CSLB the info. He won't have time to file a lien until he gets done with the proper paperwork and penalties.
