Air bags didn't deploy

    I have a 2007 Toyota 4 Runner completely stock. I was rear-ended and the other truck hit my bumper but the stock hitch stopped the airbags from deploying. Could this be a design flaw

    Nope. Rear end accidents won't deploy bags unless you were pushed very hard into the car in front of you.

    show a picture of damage for better responses.

    If you did not have your seatbelt on, they won't deploy either.

    If the hitch took all the impact you should get the frame checked. Assuming it was a big hit since you were concerned about the airbags

    well to tell you the officer said he was in access of 40-45mph he pushed my 4 Runner over 20+ feet. I cant show pics because it is in the hands of my lawyer and he advised me not to show any evidence of the case. the hitch should be recessed enough to allow for the airbags to deploy, but it would have to hit above or break the hitch off completely to deploy. I had it checked by a Toyota service center and it did damage the hitch enough to having to be replaced so does that tell you the extent of how hard i was hit. By the way the Toyota rep said it would have to be put on a frame wrecker to be absolutely sure that the frame is not bent.

    Airbags only deploy when hit from the front, regardless how hard they hit you in the back

    The airbag sensors are in the front and activate on a front impact.

    There are no sensors in the rear

    Are you trying to sue because the the bags did not go off? I don't think you are going to have a good case.

    Don't know your source of information, but it is wrong.

    You need to double check whatever else they are telling you. Carefully.

    I hope you're not paying for a lawyer, or that the lawyer isn't telling you that you even have a case. Airbags don't deploy on rear impacts, regardless of how fast or if he was in 'excess' of 40-45mph.

    Honestly, you have no case for design flaw. Have Toyota replace what is bent and be lucky the vehicle saved you from injuries.

    Let insurance battle it out for you, but legally, you have no grounds for a 'design flaw' suit against Toyota.

    I just want to see some sue happy leech try and argue engineering decisions and cite strangers on an Internet forum as proof.
