    Sorry I was cooking a big dinner. I think my best monetary option is to take the repair money and try and sell the truck as salvage. I'm thinking I could probably get 8k ish for the truck as is

    One or two things modded... Check out the build thread
    i know that you are ready to get back into a truck but you may want to practice some more patience and let them total the truck and just write you a check. may take a bit longer but will save you from having to do all the legwork involved with getting the truck towed off and going back and forth to the ins office to get the check and sign 14000000 pieces of paperwork. as well as the headache you will get at the dmv.

    What about interior, speakers, radio?? Instrument cluster?? Stuff like that do I need stuff to put back in place?

    The guy that did my estimate said don't worry about reinstalling and to just throw the stock stuff in the car. I'd talk to your guy though. Keep in kind, your insurance has to cover what Toyota put in the truck, the rest is up to you

    As to those having legal trouble with the insurance company: May I make a suggestion? Consider a different route for getting things done. Obviously we all know lawyers are a last result. Have you considered contacting the local TV stations about a potential "Big insurance" company putting the screws to an "unfortunate individual who was already traumatized by an accident that could have killed them"? TV stations LOVE that kind of stuff. It gets them ratings and corporations may have no trouble with lawyering up, but the risk of bad press in the news scares the crap out of them. A single court case goes unheard of, but a TV spot gets seen by millions of customers or potential customers. I had an ex-gf who fought and fought with an oil change quick lube place over not putting in the drain plug properly and causing her engine to lock up. They laughed at her when she threatened to sue, but when the TV camera showed up, they took care of her FAST then. Just a suggestion. A call to the local TV reporter that does these type of "feel good" spots wouldn't hurt.

    Have you guys ever heard of defamation of character?

    I hate to look at this situation while admitting total loss, but I really don't see how I can win this situation. I think my best bet is to research selling the car as wrecked. If I can pair that with the repair money they would have paid, that might be my best option.

    If you guys know anything about buying or selling a wrecked car, I'd greatly appreciate the info.

    So I was rear-ended in a crappy 97 jetta I had. It was only worth 5k, so it wasn't worth fixing (an as-new repair needed new trunk lid, new bumper, new quarter panel, etc).

    We ended up taking it as totalled, buying it back from the insurance company for $1300, and then having a friend of ours fix it by repair rather than replacement parts for $2k or so.

    Regardless, if we had wanted, we could have taken the totalled car and sold it. You can sell it as far as I know, not sure what the title is at that point, and if someone else fixes it, they can get a salvage title for it.

    its not totaled so no need to salvage. I have no idea how to estimate what a wrecked truck would be worth. Not to mention now I am fighting with the whole crew cause they gave them the go ahead to fix without my permission.

    If the engine, trans are good, you will still have a decent value for the truck. Start pricing out used motors, trans and then figure in the body panels that are still good along with the interior. Ask if the insurance company is willing to cut you a check for the amount of the repair. And then try to sell the truck as is for the amount you figure up from above. If you decide to salvage it and part it out, then you will have to deal with the registration and such. Do you have the title for the truck or does a bank?

    I have the title. It is not salvaged as it is not declared total loss. Plus in alabama, you do not need a salvaged title to sell.

    As stated earlier though, the insurance told the repair place they could fix it without my approval and they already have parts ordered. This is my fight now.
