All my job did for me today was send me an email saying they expect me back to work by October 10th or I would be terminated.

I’ll let my lawyer take care of that, considering I just had surgery (again!) and they were given the time line of January 25th 2023 as earliest possible return.

If you got hurt at work and they are trying to terminate you because you are missing days due to this injury at work, it would be a dumb move on their part.

    I haven’t returned since original injury 9/28/21

Workman comp company (Employers) processes everything soooooo slow. After appointments I email updates to my lawyer and he sends to WC and HR of my company. If they don’t get an email 24 hrs after scheduled appointment they try to bully me. But they’ll take 3!! Months to approve a surgery?!

Did you get hurt as a result of work? If so, then the ball is pretty much in your court.

As ridiculous as it sounds, I picked up an 80pound box of ground beef. The left side of the box handle broke and my knee jerk reaction was to continue to hold the box with my right arm and lift it up to put on the push cart that was in front of me. It only took 80 pounds and whatever force of that weight falling is to dislocate my right arm at the shoulder. Tearing my rotorcuff and labrum. Of course I called my supervisor immediately and under his advisement I finished out the day (after putting my shoulder back into place manually, yeah it hurt).

It’s been a ridiculous journey over the past year, I’ve lost over 55k in salary in that time and it only goes up everyday. I do get paid the maximum allowed in Alabama from work comp - only positive that it’s tax free lol

Those are indemnity payments. You and your lawyer should try and settle. What is your MMI with this injury?

Dang took forever to get it to quote. MMI hasn’t been determined yet with the surgery being done again. Prior to the redo we never discussed actual rating because he just kept me out of work due to continued pain (duh the rotorcuff was still torn lol)

Employers has tried to settle twice now. Both times being between 2-2.5x my yearly salary - but they want to cut medical off. I refuse to cut medical off. Lawyer has suggested we start at 10x yearly salary plus 10 years medical.
