    As far as I can tell it is new, has the new software. I checked the serial number on the apple site and it says the warranty has expired. that doesn't necessarily mean that it's a refurb though, they may not be warrantying the replacements because it was free to the customer.

    well its just cause i was gonna sell it to a member that wants the new nano, but i dont want to charge him for a new one if its refurbed, but i wouldnt charge him the new price, it will be a little lower, that way he gets a deal.

    yeah i read that part, i dont like their crap earbuds anyways, they hurt my ears. and i still have my original cords

    oh and the other guy has an ipod touch, so he has cords, and wants something smaller
