Anybody had a new car bought back? Lemon Law etc?

    Just for discussion sake I'm curious if anyone has dealt with a situation where a new car had issues that were deemed worthy of the manufacturer taking it back? Anybody dealt with Toyota recently in something like this? Just curious what the process entails overall? What rights do owners have etc?
    I assume I'm jumping the gun BIG TIME, but my new '18 has a sporadic SRS Light that comes and goes and they are having a hard time diagnosing it. It's at the dealer now for the 3rd time overall regarding the issue they can't replicate or diagnose(no codes, no history codes).
    Again, I'm just curious and wanted to bring it up for discussion's sake.

    We had/owned two (2) Mercedes GL550's. Both were bought back by MBUSA. Excellent customer service. The first one had electrical and engine lights that came "ON" within days of driving it home. After weeks of diagnosis and trying to resolve the issue through the local dealer, I told them, you can keep this one and we will order/purchase a new vehicle. I believe they had the vehicle for a total of more than 30 days and could not solve and/or fix the issue. So, we moved forward, MBUSA bought back the vehicle and we ordered/bought a new one.

    Needless to say, the 2nd vehicle was worse than the first!!! After three (3) separate occasions, in which the vehicle completely shut-down while driving and operating, I went back to MBUSA and once again said, you can buy this "lemon" back. After a couple well written letters sighting saftey and life threatening concerns, MBUSA bought the vehicle back.

    It can be done, but you need to know what the requirements for Lemon Law are for your state and build a case that clearly demonstrates the issues. In both instances the dealer also helped by documenting the reported issues and I had also requested that a case be opened through MBUSA Customer Care/Service. Once, a case is opened they have to investigate and it starts a paper trail.

    Tell them to replace the ECU and then all the airbags and then the wire harnesses in that order.

    Check out the F-150 forums. I stumbled on there a few days back. There is a recent thread where a ton of owners have gotten theirs bought back (a ton as in way more than i expected). They make it sound easy and common on that rig. Just nuts. This was all due to the noisy timing chain I think.

    Yes. Subaru had to buy back my Forester. They ended up spending over SIX times more (after lawyer & court fees) than they would have, had they replaced the original failed engine (still under warranty). Terrible company, terrible field representative, terrible customer service! But great car with great traction. Forester was my 2nd Subaru and now I will never own another just because of their company policies.

    Yes. Had a new 1988 Toyota Carolla returned under New Mexico lemon law.
    Make copies of all service repairs and log all conversations with service department/Toyota. Retain a lawyer to help with procedure. Every state lemon laws are different.

    Actually, my first post on TW was about this. 3 weeks after I bought my 2019 Tacoma, I found hail damage on the roof. The next day, I found wet carpet under the back seats. About a week of back and fourth with the general manager and they ended up trading me into another of the same truck. I’ve owned several vehicles but this was my first new car buying experience.

    Too many to remember
    I had a 2009 BMW M6 lemon lawed, the convertible top keep getting stuck down and the 5th time it happened it started raining on me. I ended up driving straight to the dealership in the pouring rain with the top down in a $125k car... the look on the GM’s face was priceless when I pulled up. BMW bought the car back and I ended up getting every penny back including tax, I basically got to drive the car for 2yrs for free. I was so impressed with the way BMW handled the situation that I bought a brand new M3 the day I got my check in the mail.


    I also never paid one dollar in legal fees and the process was painless, it was BMW’s idea to buy the car back... I said ok and the check showed up 2 weeks later
