    I'm thinking about telling him he's welcome to move out as soon as possible. While he lives here he must still observe the policies and rules in the lease. But the length of commitment no longer applies.

    On a serious note: Check into the Landlord's/property owners rights (google) for your state. I believe that one lawful way to have the lease terminated is for the property owner to state in a letter that the house will be used by family and thus the lease is legally terminated. Of course the lease will no longer be binding so that means they will suffer no repercussions for leaving early (promise to pay till end of lease). The deposit rule will remain the same, to be returned should all due rent is paid up according to dates of stay and should no damage to property be recorded.

    He had moved the trash to be under the sink in a tiny ass uncovered container and moved my larger trash can into the dining room to be used for cans/bottle recycling.

    I just moved my main trash can back to the kitchen where it's been for the last 3 years. Waiting for him to get home to see his reaction. I gave his idea a chance like a good roommate but now I'm tired of his shit.

    I'm not a child who just needs to learn the benefit of how this guy thinks things should be. Suck my dick kid. (Or stay the hell away from my dick if you're gay)

    I say, since you're an agent for the owner (your parents), that you have final say in what goes on.

    Or get with him and lay down some rules....he can be OCD as much as he likes IN HIS ROOM. But no OCD in the common areas. No gay shit in his room though, must leave for that. And he cooks himself dinner. And he's responsible for the clean up.

    Last year in the dorms, my roommate was the same way, except he ate other stuff). Would only leave to go to class sometimes. Would stay up all night/day. Stunk like hell!

    You have no fricken idea!! It was so bad that I NEVER closed the window even if it was snowing.

    I had roomates at one time that were kinda like you decribeing. I made a cake one time (go ahead and laugh I know but when your single and you want a cake you just got to make it yourself) and my roomates asked if they could have a piece... I told them yes cause I share, when i came home a few hours later there was only 1 piece left and it was a whole cake when i left. I was pissed so a few days later i made another cake this time i put about 1 cup of salt in the batter... they actually ate 2 pieces of the salty cake too. They did nothing around the house and I complained and it did no good.

    Good luck man. Your lucky I couldn't kick them out as they were military assignments.

    Can a tenant be evicted if the landlord wants to use the unit themselves?
    Yes, a tenant can be evicted if a landlord "in good faith" requires the unit for:

    • their own use,
    • the use of an immediate family member, or
    • the use of a person who will provide care services to the landlord or a member of the landlord’s immediate family, if the person who will be receiving the care services lives in the same building or complex.
    Once the landlord gives the tenant a notice terminating the tenancy for this reason, they can apply to the Board for an order evicting the tenant. However, a tenant can only be evicted at the end of their tenancy and only if the Board issues an eviction order.

    I'm trying to be somewhat sympathetic about the fact it would be tough for him to find a place once the school year has started. But I really want him gone.

    Thanks for the info on having family members require the space. That might be worth a try.
