    Are you building a pistol or a registered NFA weapon? Otherwise, a rifle with a buttstock has to have a 16" barrel to be legal.

    And if you are building a pistol or an SBR, yes - Del-Ton makes upper assemblies that will work, like these 3 (well, 2 - don't know why the first one is labeled as a pistol upper)

    :rolleyes: I agree with UTG but DelTon sells a wide range of stuff, from entry level to mid-tier. As long as you know what you're getting you can buy a quality rifle or upper from them.

    I feel pretty derpy right now :eek: What is the set length(s) for carbine? I have tried to research the hell out of this question but get so many different responses and according to bravo company, the 11.5 is carbine but should really be considered a pistol upper? holy shit... I am just trying to build a legal gun for home defense and occasional plinking. :frusty:

    Shortest you can go without getting the NFA tax stamp for an SBR (and whatever state hoops you need to jump through) is a minimum of 16"
    That measurement CAN be met on a 14.5" barrel by pinning and welding a 2" flash hider or compensator, so you can go a little shorter, but NFA laws still apply to the short upper and if you have a lower already in your possession, you can not take possession of the 14.5" barrel unless it has already been permanently converted to 16"+

    The flash hider/comp must be mounted AFTER the barrel nut and gas block are installed, so you need to decide what options you want before having it built up because once it's on, it's on forever.


    But seriously... An Ar15 is not the best weapon for home defense.
    You would be better off with an 18-20" barrel 12ga shotgun loaded with #1 or larger buckshot... birdshot will not penetrate denim and leather and still retain enough energy to disable an attacker.
    Back up the shotgun with a handgun, 9mm or larger, but not so large that you can't afford to practice and can't handle it well.

    Rich covered it well. Just look for a carbine with a 16" barrel and you'll be Ok. I sometimes wonder with the popularity of online sales, how many illegal short barrel rifles are floating around out there with owners who are clueless that it's a crime.

    Thank you for the info. I already have the lower. The upper is all I need to complete the project. Basically... to confirm what you are saying, LEGALLY, I am safe to buy an assembled 16" upper without wrinkling any of the feds undies?

    Daniel Defense 14.5 with Smith Vortex flash hider.
    Troy TRX rail.
    Bought the upper receiver from a guy on Calguns who was cleaning house.
    Assembled and the FH pinned and welded at Riflegear in Fountain Valley.
    30rd mag bodies are drilled, blocked, and riveted to 10rds (actually screwed up and one only accepts 9).

    With the buttstock collapsed (or removed) it's just a smidge over 30", so with the bullet button it's fully Kalifornistan-Legal.
    Barrel would have been legal with a slightly shorter flash hider, but the OAL would have come in under 30" so it would be a California SBR.

    100% A 16"+ upper is never a problem on the federal level.

    And on the federal level, now that a stripped lower is written up on the 4473 as "OTHER", you're actually in the clear on a shorter barrel as long as you have never installed a buttstock on the lower (and have no other "long gun" lowers).
    This was not the case a few years ago, a lower was input as a "long gun" or "handgun"... and that is what brought rise to the older "pistol" marked lowers... it ensured that the dealer would write up the 4473 as a handgun.

    Now, it is sold as an "other" and remains an "other" until assembled.
    The BATFE considers a "rifle" to be a receiver that has had both a 16" or longer barrel and a buttstock installed.
    On the federal level, your lower is still not yet a "rifle" since the upper has not been installed, however, Ohio law may be more strict.

    California has all kinds of BS requirements, and the most common way of building an AR pistol is to machine your own 80% lower.
    We can't buy an AR pistol lower from a dealer since it's off-roster and can not be made roster-exempt.
    We CAN buy a completely assembled AR pistol by having it assembled under the single shot, dimensionally complaint exemption. Once we get it home, we can remove the single-shot sled and run it as a semi-auto with 10rd mags.

    Rich is correct. Dealers CAN build you an AR pistol, but that requires the lower to be DROS'd as a pistol, which we won't really do. The only way around it is by charging a 12% excuse tax. Otherwise you're limited to either buying a complete AR pistol, are starting from an 80% lower
