My suspicion surrounding this entire brace thing is that the ATF knows it won't stick. I think thats the entire point, and is the way they've always operated. They're always looking for that foot in the door, to find an inch and take a mile. My opinion on the matter is that I think they're just soliciting pistol braced AR gun owners to register their pistol braced AR's as "SBR's", fishing for 'actual gun owners of these weapons' to self-define these weapons as such. Whats that gonna do for the rest, when it all probably overturns? Just turns 2A advocates against each other "unintentionally" because now gun owners are the ones suggesting that braced AR pistols are actually "rifles". Its a game of chess, and you don't win in one move; you also don't win on a single strategy. What they're doing is an entire mess for law abiding gun owners, and no matter the turnout of this one particular thing, I think its a major loss for us.

 

An interesting take - 26 USC 5848 specifically prohibits BATFE from taking legal action against anyone willfully attempting to register a "prohibited" item. It came about after SCOTUS was inundated with cases where people were being prosecuted for attempting to register items that they did not know were prohibited. I am obviously paraphrasing.

 

No. It says they can't use information in the application you submitted against you in a criminal proceeding:

28 USC ss 5848

"No information or evidence obtained from an application, registration, or records required to be submitted or retained by a natural person in order to comply with any provision of this chapter or regulations issued thereunder, shall, except as provided in subsection (b) of this section, be used, directly or indirectly, as evidence against that person in a criminal proceeding with respect to a violation of law occurring prior to or concurrently with the filing of the application or registration, or the compiling of the records containing the information or evidence."

"(b) Furnishing false information

Subsection (a) of this section shall not preclude the use of any such information or evidence in a prosecution or other action under any applicable provision of law with respect to the furnishing of false information."
