No offense but you really should have checked more carefully. He has the legal option to not hive you anything back.

buy new from a reputable company with a return policy that is reasonable... if you can't afford it... save up... less headaches this way - buying used suspension parts is also dangerous.

I can see both sides to this problem. But I think the seller doesnt really owe the OP anything. On the contrary though, I do feel the OP's pain, because we have all been there and gotten screwed on a private party deals like this. Just chalk it up to a learning experience and move on.

On a separate note though, whenever I sell stuff, I usually put in the ad, "items are sold as is, where is, with all faults known, and unknown" This should be understood without saying by both parties, but its usually best to put it in the ad so there is no confusion.

The kid knew what he was doing. He hoped you would not call him back. Really...look at what he said and how he parsed all the tires. First he sold u four "good tires" then he said you only really wanted 2 so what is the problem. The kid is unsavory and attempted to make u look like u were being greedy. If he had any shred of honesty he would not have tried to squirm out of this. But...next time, inspect everything first before any loot changes hands.

    2. youre fucked for the money the little shit isnt gonna pay up
    3. sell used ones buy new ones

i sold a set here a few years back. bought em used, never mounted, sold them. guy went to install found a gash on one of the tires. he brought it back with a receipt for a new one. we split the cost of the new one and we were both happy.

I want to believe that he didn't know about the nail. I never said that he screwed me over. Just that he was giving me a hard time and make me feel like i was the problem.
All i want is go back in time. He keeps his 4 tires and i keep my money. That's it, simple as that. I don 't see how he feel like he looses. is not like he had them for sale, he contacted me via pm once I posted that I needed to buy tires. Like I told him: if I keep the tires I'll have 3 tires that I don't need . If i get my money back he goes back to having 4 tires ( just like last week) .
He contacted me via pm, he is not happy about this thread. He even insinuated that i put the nail in the tires. He says that he is working on getting my money back.

ALSO I WANT TO MAKE CLEAR THAT HE DOESN'T HAVE 18 WHEELS, I MADE A MISTAKE AND I APOLOGIZE FOR THAT

I remember a year or so ago when I sold a paintball loader to a guy, knowing I had once resoldered a bad wire connection on the circuit board, and when he got it in the mail, for whatever reason the soldering issue returned and I reimbursed him 15 bucks to fix it.

    Sucks the tires are unrepairable.

As other posters have stated, sometimes you come out on top at the end of these deals and sometimes you eat dirt.

No, I do! I don't see where the OP is wrong! The tires were said to be in GOOD condition, and that is what should be expected. One is NOT USABLE! AGAIN, I honestly don't think the kid sold him a bad set of tires on purpose but I do think that the money should be refunded. His intent was to buy four good usable tires and he only has three!!

Doesn't matter how old the seller is, business is business. This guy is 17, and he is the one who initiated the sale. It's not like we are dealing with an 8 year old who doesn't understand fairness in trade, this is someone who knew how much he wanted and what they were worth. He is one year away from being an adult. He got 350 hard earned bucks in exchange for something that cannot be used. That isn't fair. Granted, he is having a hard time getting the money, this is all part of growing up and a lesson to be learned.

Okay m3bassman, I see your point.

I figure that the nail got "lost" amongst the rocks in the tread and that was a simple mistake, over looking the nail - and your point about being committed to the sale once money exchanged hands makes sense. The analogy of buying a truck sight unseen made it clearer for me and was a good example. Thank you

OP, try making a payment plan with the seller. Get back $X per week until you get $87 back. You bought a defective tire that was supposed to be "like new." No it isn't some corporation, but anyone who sells something should be held to some standard.

As much as it is the buyers obligation to check what he is buying, it should be the sellers to make sure everything is in the condition that he says it is. Seller claimed it was in new condition. He should have checked to make sure that everything was as good as he claimed. Get your $87 back and end this shit.

Okay, so say you buy a 1 year old used truck with 15k miles. It should be "like new" right? You buy it but find out a month later that the frame has become one giant chunk of rust covered by black spray paint. Would you want your money back?
