    Seems strange... turning vehicle should always yield unless it's a protected turn. Even if it was red, she has no more right to turn than you do going straight and I would think should still yield. Here it's not legal to sit in the middle of an intersection and wait for an opportunity to turn, you can only enter an intersection to turn if it's clear to turn, unless protected turn of course. But that is not really enforced.

    That depends on where you are when it turns yellow. Obviously we were not there and we don't have video, so no one here can say that OP had enough time to stop or if OP was just at the intersection when it turned yellow, which would have given enough time to go through. Also, there could have been someone behind OP forcing him through the light, or resulting in getting rear ended.
    We also don't know where the other party had their vehicle and were they trying to make the light.
    Before I got a dash cam, in my old Dakota I got hit from the side from a young driver. Before the cops got there her boyfriend said, hey, if we just talk about some cash we can get out of here. I said, O.k., how much you gonna give me? He said, no, I mean you pay us, you were going too fast and she didnt see you. Keep in mind, I got hit on the passenger front wheel. Also, this was on the main Street on Christmas weekend. Traffic was slow. Anyway, I said we will just wait for the cops to sort it out. I also didn't know at the time, but the lady behind me stopped to write her statement. She wrote it up as their fault, and she worked for the DA. :thumbsup:

    All great points about the light. I'll definitely contest it and see how it goes. Nothing to lose at this point. I have a nice rental truck that is costing me nothing, and total out of pocket will be $500 according to Geico. I hate having to wait till Tuesday to even have it looked at to access the damage. Like I said mostly concerned about the transfer case. Kind of weird that the collision sensor never went off...... lucky I think that no air bags activated.

    I think the Black might? But I have a hero 7 silver. I have to manually turn it on and off and reformat the card after 9 hours of footage. But its one press to start recording and one press to stop as its generally alway hibernating.

    Well went to the body shop this morning and spoke with my friend that owns it. He said it wasn't really that bad. Informed me he'd do the body work and then have the Toyota dealership up the street take care of the suspension and go over the transfer case. All Toyota genuine parts. Nice to have a buddy you trust in the business. Also heard from the geico adjuster and he'll be looking at it today. In the mean time get to enjoy my Ram pickup..... 18 mpg, only bad thing is it takes up a ton of real estate lol

    Update: Damage is approximately $4,200 Should be finished in about 10-14 days

    There really not that expensive $150 for a thinkware with two cameras and a $30 hardwire cable It does motion recording when I'm not there(in the golf R) . I also have a cheap uniden I bought for 25 bucks in the truck(ebay) .

    Agreed, that's why you keep your trap shut about having a dash camera. After you've left the scene, give the footage to your insurance company and/or lawyer to review. Let them determine if the footage has you clearly in the right.

    KY_Rob is right, the footage can be used against you. The other party can review all the camera's footage and see if you were driving reckless, distracted or upset even way before the accident occurred.

    It isn't the act of passing through an intersect while the light is yellow that is the determining factor, it's what action you took after the light turned yellow. If you were slowing down you met one criteria, on the other hand if you simply maintained speed or sped up you were guilty of "demanding the right of way" this is the first problem for you. Once the light turns yellow if you do anything other than prepare to stop you're hosed legally. The common behavior is the opposite and is what most of us do, but it's wrong. We get by with it most of the time, but when the outcome turns to shit you have almost zero defense.

    The other driver is guilty of the same thing, she demanded the right of way by proceeding while you were in the intersection but the officer did not charge her, this is the second problem for you. He is not obligated to charge anyone, discretion is allowed and seldom overturned by a court.

    4511.42 Right-of-way rule when turning left.
    (A) The operator of a vehicle, streetcar, or trackless trolley intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right of way to any vehicle, streetcar, or trackless trolley approaching from the opposite direction, whenever the approaching vehicle, streetcar, or trackless trolley is within the intersection or so close to the intersection, alley, private road, or driveway as to constitute an immediate hazard.

    The police did not witness the accident, nor did any disinterested party come forward to verify the circumstance. It is her word vs mine. It is next to impossible to hit someone with your front tire.

    Not in all cases. When my 06 Tacoma was totaled I was in the left turn lane not moving when the other vehicle crossed the lines and hit me.
    The other drivers insurance picked up 100% of the bill.

    That sucks. Glad no one was injured though. Sounds like you’ll be able to get off that ticket if you do some prep work and go to court......On a side note; I hope that tow truck didn’t take you very far (or fast) with your rear wheels still on the ground? Especially if you’ve got an automatic transmission.......

    Yes of course you’re right “Not in all cases”. My bad for generalizing. In my case stopped at a stop sign and got rear ended. Not totaled. My insurance agent told me how it was settled between the insurance companies otherwise I wouldn’t have known.

    If your car was in any part past the limit line and at least partly in the intersection on a yellow signal the car turning left into you is at fault for not yielding to oncoming traffic. In any state.
